S.F. 2035 Section 1. Section 216C.11, subsection 1, Code 2022, is 1 amended to read as follows: 2 1. a. A person with a disability, a person assisting a 3 person with a disability by controlling a service animal or 4 a service-animal-in-training, or a person training a service 5 animal has the right to be accompanied by a service animal 6 or service-animal-in-training, under control, in any of the 7 places listed in sections 216C.3 and 216C.4 without being 8 required to make additional payment for the service animal or 9 service-animal-in-training. 10 b. The person is liable for damage done to any premises or 11 facility by a service animal or a service-animal-in-training. 12 c. Paragraph “a” does not apply if the place listed in 13 section 216C.3 or 216C.4 is located in a county or city 14 that prohibits or restricts the possession of a specific 15 breed or perceived breed of dog and the service animal or 16 service-animal-in-training is of the prohibited or restricted 17 breed or perceived breed of dog. 18 EXPLANATION 19 The inclusion of this explanation does not constitute agreement with 20 the explanation’s substance by the members of the general assembly. 21 This bill relates to service dogs in the context of 22 county or city breed restrictions. Current law grants 23 a person with a disability, a person assisting a person 24 with a disability by controlling a service animal or a 25 service-animal-in-training, or a person training a service 26 animal the right to be accompanied by the service animal or 27 service-animal-in-training, under control, at public facilities 28 and accommodations without being required to make additional 29 payment for the service animal or service-animal-in-training. 30 The bill provides that the right does not apply if the 31 public facility or accommodation is in a county or city 32 that prohibits or restricts the possession of a specific 33 breed or perceived breed of dog and the service animal or 34 service-animal-in-training is of the prohibited or restricted 35 -1- LSB 5145XS (4) 89 js/ns 1/ 2
