Unless otherwise specifically provided under federal or 3 state law, immunization or vaccination of a minor in this state 4 is subject to prior written consent by the minor’s parent or 5 legal guardian. 6 2. For the purposes of this section, “minor” means a person 7 who has not attained majority as described in section 599.1. 8 EXPLANATION 9 The inclusion of this explanation does not constitute agreement with 10 the explanation’s substance by the members of the general assembly. 11 This bill provides that unless otherwise specifically 12 provided under federal or state law, immunization or 13 vaccination of a minor in this state is subject to prior 14 written consent by the minor’s parent or legal guardian. The 15 bill defines “minor” consistent with Code section 599.1, which 16 provides that the period of minority extends to the age of 17 18, but all minors attain their majority by marriage; and 18 that a person who is less than 18 years of age who is tried, 19 convicted, and sentenced as an adult and committed to the 20 custody of the director of the department of corrections shall 21 be deemed to have attained the age of majority for purposes of 22 making decisions and giving consent to medical care, related 23 services, and treatment during the period of the person’s 24 incarceration. 25 -1- LSB 5023XS (3) 89 pf/rh 1/ 1
