Section
313.4,
subsection
1,
paragraph
c,
Code

2021,
is
amended
to
read
as
follows:

c.
The
commission
may,
after
consultation
with
stakeholders
3
including
regional
planning
affiliations,
metropolitan
planning
4
organizations,
the
Iowa
state
association
of
counties,
and
the
5
Iowa
league
of
cities,
periodically
allocate
moneys
from
the
6
fund
for
the
establishment,
construction,
and
maintenance
of
7
the
secondary
road
system
and
the
municipal
street
system
in
8
exchange
for
retaining
all
or
a
portion
of
federal
aid
road
9
funds
that
would
otherwise
be
allocated
to
counties
and
cities.

However,
the
commission
shall
not
allocate
moneys
from
the
fund
11
in
this
manner
to
a
county
or
city
until
the
county
or
city
12
certifies
to
the
commission
that,
for
each
project
receiving
13
moneys
from
the
fund,
the
county
or
city
will
comply
with
the
14
buy
America
requirements
set
forth
in
23
C.F.R.
§635.410.

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
17
the
explanation’s
substance
by
the
members
of
the
general
assembly.

Current
law
permits
the
state
transportation
commission
19
(STC)
to
allocate
moneys
from
the
primary
road
fund
(PRF)
20
for
the
establishment,
construction,
and
maintenance
of
the
21
secondary
road
system
and
the
municipal
street
system
in
22
exchange
for
retaining
all
or
a
portion
of
federal
aid
road
23
funds
that
would
otherwise
be
allocated
to
counties
and
cities.

This
bill
restricts
the
STC
from
allocating
PRF
moneys
25
in
this
manner
until
the
county
or
city
certifies
that,
for
26
projects
receiving
PRF
moneys,
the
county
or
city
will
comply
27
with
federal
buy
America
requirements
(23
C.F.R.
§635.410).

Under
those
requirements,
a
project
must
either
include
no
29
permanently
incorporated
steel
or
iron
materials,
or
if
steel
30
or
iron
materials
are
to
be
used,
all
manufacturing
processes,
31
including
application
of
a
coating,
for
these
materials
must
32
occur
in
the
United
States
unless
certain
exceptions
apply.
