Section
1.
Section
299.4,
Code
2021,
is
amended
by
adding
1
the
following
new
subsection:

NEW
SUBSECTION
.
3.
If
the
governor
proclaims
a
state
of

public
health
disaster
emergency
pursuant
to
section
29C.6
for
4
the
county
in
which
independent
private
or
private
instruction
5
under
chapter
299A
is
provided,
the
parent,
guardian,
or
legal
6
custodian
of
a
child
who
is
of
compulsory
attendance
age,
who
7
placed
the
child
under
independent
private
instruction
or
8
private
instruction
under
chapter
299A,
not
in
an
accredited
9
school
or
a
home
school
assistance
program
operated
by
a
school
10
district
or
accredited
nonpublic
school,
shall
furnish
to
the
11
school
district
of
residence,
as
soon
as
reasonably
possible
12
and
in
the
form
and
manner
prescribed
by
the
school
district,
13
all
of
the
information
required
for
the
report
specified
under
14
subsection
1.

Sec.
2.
Section
299A.1,
subsection
2,
paragraph
b,
16
subparagraph
(6),
Code
2021,
is
amended
to
read
as
follows:

(6)
(a)
Provides,
upon
written
request
from
the
18
superintendent
of
the
school
district
in
which
the
independent
19
private
instruction
is
provided,
or
from
the
director
of
the
20
department
of
education,
a
report
identifying
the
primary
21
instructor,
location,
name
of
the
authority
responsible
for
the
22
independent
private
instruction,
and
the
names
of
the
students
23
enrolled.

(b)
Provides,
if
the
governor
proclaims
a
state
of
25
public
health
disaster
emergency
pursuant
to
section
29C.6
26
for
the
county
in
which
the
independent
private
instruction
27
is
provided,
a
report
from
the
parent,
guardian,
or
legal

custodian
of
the
child
placed
in
independent
private
29
instruction
to
the
school
district
of
residence
in
accordance

with
section
299.4.

This
bill
requires,
if
the
governor
proclaims
a
state
6
of
public
health
disaster
emergency
in
a
county
in
which
7
independent
private
or
private
instruction
is
provided,
the
8
parent,
guardian,
or
legal
custodian
who
places
a
child
in
9
independent
private
instruction
or
private
instruction
to
10
submit
the
same
report
to
the
school
district
of
residence
11
that
is
required
for
a
child
placed
in
competent
private
12
instruction.

The
information
must
be
furnished
as
soon
as
reasonably
14
possible
and
must
include
the
name
and
age
of
the
child,
the
15
period
of
time
during
which
the
child
has
been
or
will
be
under
16
private
instruction
for
the
year,
an
outline
of
the
course
of
17
study,
and
the
name
and
address
of
the
instructor.
18
The
first
time
such
a
report
is
filed
by
a
person
on
behalf
19
of
a
child
placed
in
independent
private
instruction
or
private
20
instruction,
the
person
must
also
provide
the
district
with
21
evidence
that
the
child
has
had
the
immunizations
required
22
under
Code
section
139A.8,
and,
if
the
child
is
elementary
23
school
age,
a
blood
lead
test.
The
term
“outline
of
course
of
24
study”
includes
subjects
covered,
lesson
plans,
and
time
spent
25
on
the
areas
of
study.
