S.F. 143 Section 1. Section 331.301, Code 2021, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 18. A county shall not adopt, enforce, 3 or otherwise administer an ordinance, motion, resolution, or 4 amendment that is specific to the breed or perceived breed of 5 a dog. This subsection does not inhibit the authority of a 6 county to adopt, enforce, or administer an ordinance, motion, 7 resolution, or amendment that applies to all dogs. 8 Sec. 2. Section 364.3, Code 2021, is amended by adding the 9 following new subsection: 10 NEW SUBSECTION . 13. A city shall not adopt, enforce, or 11 otherwise administer an ordinance, motion, resolution, or 12 amendment that is specific to the breed or perceived breed of 13 a dog. This subsection does not inhibit the authority of a 14 city to adopt, enforce, or administer an ordinance, motion, 15 resolution, or amendment that applies to all dogs. 16 EXPLANATION 17 The inclusion of this explanation does not constitute agreement with 18 the explanation’s substance by the members of the general assembly. 19 This bill prohibits counties and cities from adopting, 20 enforcing, or administering an ordinance, motion, resolution, 21 or amendment specific to the breed or perceived breed of a dog. 22 The bill does not inhibit the authority of a county or city to 23 adopt, enforce, or administer an ordinance, motion, resolution, 24 or amendment that applies to all dogs. 25 -1- LSB 1901XS (3) 89 js/ns 1/ 1
