H.F. _____ Section 1. Section 358.12, subsection 1, Code 2022, is 1 amended to read as follows: 2 1. The trustees elected as provided in section 358.9 3 constitute a board of trustees for the district by which they 4 are elected. The board of trustees is the corporate authority 5 of the sanitary district and shall manage and control the 6 affairs and property of the district. A majority of the board 7 of trustees shall constitute a quorum, but a smaller number may 8 adjourn from day to day. The board of trustees shall elect a 9 president, a clerk, and a treasurer from its membership and may 10 employ employees as necessary, who shall hold their employment 11 during the pleasure of the board. The board shall prescribe 12 the duties and fix the compensation of all employees of the 13 sanitary district and the amount of bond to be filed by the 14 treasurer of the district and by any employee for whom the 15 board may require bond. The members of the board of trustees 16 shall receive a per diem of one two hundred dollars for 17 attendance at a meeting of the board or while otherwise engaged 18 in official duties, but the total per diem for each member 19 shall not exceed two thousand four thousand eight hundred 20 dollars for a fiscal year. However, the board of trustees, 21 by resolution, may establish for its members a lower rate of 22 pay than is fixed by this section . The members of the board 23 shall also be reimbursed for their travel and other necessary 24 expenses incurred in performing their official duties. Travel 25 expenses are reimbursable at the rate specified in section 26 70A.9 . 27 EXPLANATION 28 The inclusion of this explanation does not constitute agreement with 29 the explanation’s substance by the members of the general assembly. 30 This bill relates to the compensation of sanitary district 31 board of trustees members. 32 The bill provides that a sanitary district board of trustees 33 member shall receive per diem compensation in the amount of 34 $200 for attendance at a board meeting or while otherwise 35 -1- LSB 6223YC (2) 89 es/rn 1/ 2
