H.F. _____ Section 1. Section 307A.1A, subsection 1, Code 2022, is 1 amended to read as follows: 2 1. a. There is created a state transportation commission 3 which shall consist of seven members, not more than four of 4 whom shall be from the same political party. The governor 5 shall appoint the members of the state transportation 6 commission for a term of four years beginning at 12:01 a.m. 7 on July 1 in the year of appointment and expiring at 12:00 8 midnight on June 30 in the year of expiration, subject to 9 confirmation by the senate. For each of the six regions of 10 the state, as designated in paragraph “b” , the governor shall 11 appoint one member to represent the region, and the member 12 shall reside in the region. The governor shall appoint one 13 member to represent the state at large, and the member shall 14 reside in the state. 15 b. For purposes of this subsection, the state is divided 16 into six regions, which shall be composed of the following 17 counties: 18 (1) Region 1 consists of Boone, Greene, Grundy, Hamilton, 19 Hardin, Jasper, Marshall, Polk, Poweshiek, Story, Tama, and 20 Webster. 21 (2) Region 2 consists of Allamakee, Black Hawk, Bremer, 22 Butler, Cerro Gordo, Chickasaw, Clayton, Fayette, Floyd, 23 Franklin, Hancock, Howard, Humboldt, Kossuth, Mitchell, 24 Winnebago, Winneshiek, Worth, and Wright. 25 (3) Region 3 consists of Buena Vista, Calhoun, Carroll, 26 Cherokee, Clay, Crawford, Dickinson, Emmet, Ida, Lyon, Monona, 27 O’Brien, Osceola, Palo Alto, Plymouth, Pocahontas, Sac, Sioux, 28 and Woodbury. 29 (4) Region 4 consists of Adair, Adams, Audubon, Cass, 30 Dallas, Fremont, Guthrie, Harrison, Madison, Mills, Montgomery, 31 Page, Pottawattamie, Ringgold, Shelby, Taylor, and Union. 32 (5) Region 5 consists of Appanoose, Clarke, Davis, Decatur, 33 Des Moines, Henry, Jefferson, Keokuk, Lee, Louisa, Lucas, 34 Mahaska, Marion, Monroe, Muscatine, Van Buren, Wapello, Warren, 35 -1- LSB 6185YC (4) 89 th/ns 1/ 3
H.F. _____ Washington, and Wayne. 1 (6) Region 6 consists of Benton, Buchanan, Cedar, Clinton, 2 Delaware, Dubuque, Iowa, Jackson, Johnson, Jones, Linn, and 3 Scott. 4 Sec. 2. NEW SECTION . 307A.9 Residency requirement —— 5 resignation from office. 6 Any of the following members of the commission shall be 7 deemed to have resigned from the commission and the vacancy 8 shall be filled as described in section 307A.4: 9 1. A member appointed to represent a region of the state, 10 as described in section 307A.1A, subsection 1, who no longer 11 resides in the region. 12 2. A member appointed to represent the state at large, 13 as described in section 307A.1A, subsection 1, who no longer 14 resides in the state. 15 Sec. 3. TRANSITION. The first regular term appointment 16 made on or after the effective date of this Act shall represent 17 region 1. The second regular term appointment made on or after 18 the effective date of this Act shall represent region 2. The 19 third regular term appointment made on or after the effective 20 date of this Act shall represent region 3. The fourth regular 21 term appointment made on or after the effective date of 22 this Act shall represent region 4. The fifth regular term 23 appointment made on or after the effective date of this Act 24 shall represent region 5. The sixth regular term appointment 25 made on or after the effective date of this Act shall represent 26 region 6. The seventh regular term appointment made on or 27 after the effective date of this Act shall represent the state 28 at large. 29 Sec. 4. EFFECTIVE DATE. This Act, being deemed of immediate 30 importance, takes effect upon enactment. 31 Sec. 5. APPLICABILITY. This Act applies to members of the 32 state transportation commission appointed and confirmed on or 33 after the effective date of this Act. 34 EXPLANATION 35 -2- LSB 6185YC (4) 89 th/ns 2/ 3
H.F. _____ The inclusion of this explanation does not constitute agreement with 1 the explanation’s substance by the members of the general assembly. 2 Under current law, the state transportation commission (STC) 3 consists of seven members, not more than four of whom may 4 be from the same political party. The governor appoints the 5 members of the STC for a term of four years. The governor’s 6 appointees are subject to confirmation by the senate. 7 This bill requires that for each of the six regions of the 8 state, as designated by the bill, one member of the STC must be 9 appointed to represent, and must reside in, each region. The 10 seventh member of the STC must be appointed to represent the 11 state at large, and must reside in the state. The bill divides 12 the state into six regions with each region consisting of 13 certain adjoining counties. The regions mirror the department 14 of transportation’s six highway division operations districts. 15 The bill provides that a member who no longer resides in 16 the region or state, as applicable, shall be deemed to have 17 resigned from the STC and the vacancy shall be filled as 18 provided by current law. 19 The bill takes effect upon enactment, applies to members of 20 the STC appointed and confirmed on or after the effective date 21 of the bill, and sets forth transition provisions. 22 -3- LSB 6185YC (4) 89 th/ns 3/ 3
