H.F. _____ Section 1. Section 28E.30, Code 2022, is amended to read as 1 follows: 2 28E.30 Agreement for law enforcement administrative services. 3 A county and a city within the county may enter into an 4 agreement to provide administrative services through the county 5 sheriff to the city for its police department. In addition 6 to other provisions required by this chapter , the agreement 7 shall specify the administrative services to be provided by 8 the sheriff and the administrative or supervisory relationship 9 between the sheriff and the mayor and city council. The 10 agreement is subject to the approval of the county sheriff. 11 The sheriff may accept compensation for the administrative 12 services provided to the city, which compensation is in 13 addition to the sheriff’s compensation authorized under section 14 331.907 by the county board of supervisors . The additional 15 compensation shall not be included in computing the total 16 annual compensation of the sheriff pursuant to section 331.904, 17 subsection 2 . 18 Sec. 2. Section 331.212, subsection 2, Code 2022, is amended 19 by adding the following new paragraph: 20 NEW PARAGRAPH . i. Setting the compensation schedule of 21 elected county officers, if the board has not established a 22 county compensation board pursuant to section 331.905. 23 Sec. 3. Section 331.215, subsection 1, Code 2022, is amended 24 to read as follows: 25 1. The supervisors shall receive an annual salary or 26 per diem compensation as determined under section 331.907 . 27 The annual salary or per diem shall be full payment for all 28 services rendered to the county except for reimbursement for 29 mileage and other expenses authorized in subsection 2 . 30 Sec. 4. Section 331.321, subsection 1, paragraph l, Code 31 2022, is amended to read as follows: 32 l. Two members of the county compensation board in 33 accordance with section 331.905 , if the board of supervisors 34 has established a county compensation board . 35 -1- LSB 6187YC (2) 89 js/ns 1/ 3
H.F. _____ Sec. 5. Section 331.322, subsections 6 and 7, Code 2022, are 1 amended to read as follows: 2 6. Review Annually prepare and review the compensation 3 schedule, or review the final compensation schedule of the 4 county compensation board if the board of supervisors has 5 established a county compensation board, and determine the 6 final compensation schedule in accordance with section 331.907 . 7 7. Provide necessary office facilities and the technical 8 and clerical assistance requested by the county compensation 9 board to accomplish the purposes of sections 331.905 and 10 331.907 preparing and submitting a proposed compensation 11 schedule, if the board of supervisors has established a county 12 compensation board . 13 Sec. 6. Section 331.323, subsection 1, paragraph e, Code 14 2022, is amended to read as follows: 15 e. When the duties of an officer or employee are assigned to 16 one or more elected officers, the board shall set the initial 17 salary for each elected officer. Thereafter, the salary shall 18 be determined as provided in section 331.907 . 19 Sec. 7. Section 331.905, subsection 1, unnumbered paragraph 20 1, Code 2022, is amended to read as follows: 21 There is created in each county A board of supervisors may 22 vote to establish a county compensation board which subject to 23 the provisions of this section. The county compensation board 24 shall be composed of seven members who are residents of the 25 county. The members of the county compensation board shall be 26 selected as follows: 27 Sec. 8. Section 331.905, Code 2022, is amended by adding the 28 following new subsections: 29 NEW SUBSECTION . 7. The county compensation board shall 30 annually submit to the board of supervisors a recommended 31 compensation schedule. 32 NEW SUBSECTION . 8. A board of supervisors may dissolve a 33 county compensation board upon a majority vote of the members 34 of the board of supervisors. 35 -2- LSB 6187YC (2) 89 js/ns 2/ 3
H.F. _____ Sec. 9. Section 331.752, subsection 5, Code 2022, is amended 1 to read as follows: 2 5. The resolution changing the status of a county attorney 3 shall state the initial annual salary to be paid to the county 4 attorney when the full-time or part-time status is effective. 5 The annual salary specified in the resolution shall remain 6 effective until changed as provided in section 331.907 by the 7 board . Except in counties having a population of more than 8 two hundred thousand, the annual salary of a full-time county 9 attorney shall be an amount which that is between forty-five 10 percent and one hundred percent of the annual salary received 11 by a district court judge. 12 Sec. 10. REPEAL. Section 331.907, Code 2022, is repealed. 13 EXPLANATION 14 The inclusion of this explanation does not constitute agreement with 15 the explanation’s substance by the members of the general assembly. 16 This bill relates to methods of determining compensation for 17 elected county officers. 18 Under current law, each county has a county compensation 19 board that prepares a recommended compensation schedule for 20 elected county officers that the county board of supervisors 21 then reviews. Current law provides limitations that both the 22 county compensation board and board of supervisors must adhere 23 to in determining the final compensation schedule. 24 The bill allows a board of supervisors to vote to establish 25 a county compensation board. The county compensation board 26 shall be composed as provided under current law. The board of 27 supervisors may also vote to dissolve a county compensation 28 board. The board of supervisors is responsible for preparing 29 a compensation schedule if the board of supervisors has not 30 established a county compensation board. The bill repeals 31 the limitations that the county compensation board and the 32 board of supervisors must adhere to in determining the final 33 compensation schedule and makes conforming changes. 34 -3- LSB 6187YC (2) 89 js/ns 3/ 3
