H.F. _____ Section 1. NEW SECTION . 135.190A Opioid antagonist 1 medication fund. 2 1. An opioid antagonist medication fund for first 3 responders is created within the state treasury under the 4 control of the department. The fund shall consist of moneys 5 appropriated to or deposited into the fund. 6 2. Moneys in the fund are appropriated to the department for 7 the purchase, maintenance, and replacement of opioid antagonist 8 medication administered by first responders to persons 9 experiencing an opioid-related overdose. The department is 10 authorized to designate moneys in the fund for the purchase, 11 maintenance, and replacement of opioid antagonist medication 12 used by the department or other entities under this section. 13 3. State and local law enforcement agencies and fire 14 departments may make application to the fund for the 15 procurement of opioid antagonist medications. 16 4. The fund may consist of available federal or state moneys 17 available, as well as any available opioid lawsuit settlement 18 moneys. Funds may be transferred between other state agencies 19 and the fund as appropriate. 20 5. Notwithstanding section 8.33, moneys in the fund 21 that remain unencumbered or unobligated at the close of a 22 fiscal year shall not revert but shall remain available for 23 expenditure for the purposes designated. Notwithstanding 24 section 12C.7, subsection 2, interest or earnings on moneys in 25 the fund shall be credited to the fund. 26 6. The department shall submit a report to the 27 co-chairpersons and ranking members of the joint appropriations 28 subcommittee on the justice system and to the legislative 29 services agency on or before December 31 of each year which 30 shall contain all of the following: 31 a. A list of all expenditures from the fund made in the 32 previous fiscal year. 33 b. The amount of moneys in the fund carried over from the 34 previous fiscal year to the current fiscal year and how the 35 -1- LSB 5970YC (1) 89 as/rh 1/ 3
H.F. _____ department plans to use those moneys including any expenditures 1 in the current fiscal year. 2 c. The amount of moneys in the fund the department intends 3 to carry over from the current fiscal year to the next fiscal 4 year and how the department plans to use those moneys. 5 d. A list of all the sources of moneys deposited in the fund 6 in the previous fiscal year. 7 7. For purposes of this section: 8 a. “First responder” means state and local law enforcement 9 personnel and fire department personnel who provide or 10 administer an opioid antagonist to a person experiencing an 11 opioid-related overdose. 12 b. “Opioid antagonist” means the same as defined in section 13 147A.1. 14 c. “Opioid-related overdose” means the same as defined in 15 section 147A.1. 16 EXPLANATION 17 The inclusion of this explanation does not constitute agreement with 18 the explanation’s substance by the members of the general assembly. 19 This bill creates an opioid antagonist medication fund for 20 first responders. 21 The bill provides that an opioid antagonist medication 22 fund (fund) for first responders is created within the state 23 treasury under the control of the department of public health 24 (department). The fund shall consist of moneys appropriated 25 to or deposited in the fund and may include available federal 26 or state moneys, as well as any available opioid lawsuit 27 settlement moneys. Funds may be transferred between other 28 state agencies and the fund as appropriate. Moneys in the 29 fund are appropriated to the department for the purchase, 30 maintenance, and replacement of opioid antagonist medication 31 to be administered by first responders to persons experiencing 32 an opioid-related overdose. H.F. _____ agencies and fire departments may make application to the fund 1 for the procurement of opioid antagonist medications. 2 The bill provides that moneys in the fund that remain 3 unencumbered or unobligated at the close of a fiscal year shall 4 not revert but shall remain available for expenditure, and 5 interest or earnings on moneys in the fund shall be credited 6 to the fund. 7 The bill provides that the department shall submit a report 8 to the co-chairpersons and ranking members of the joint 9 appropriations subcommittee on the justice system and to the 10 legislative services agency on or before December 31 of each 11 year which shall contain a list of all expenditures from the 12 fund made in the previous fiscal year, the amount of moneys in 13 the fund carried over from the previous fiscal year and how the 14 department plans to use those moneys including any expenditures 15 in the current fiscal year, the amount of moneys in the fund 16 the department intends to carry over from the current fiscal 17 year to the next fiscal year and how the department plans to 18 use those moneys, and a list of all the sources of moneys 19 deposited into the fund in the previous fiscal year. 20 The bill provides definitions. 21 -3- LSB 5970YC (1) 89 as/rh 3/ 3
