1.
Section
256.84,
Code
2022,
is
amended
by
adding
1
the
following
new
subsections:

NEW
SUBSECTION
.
9A.
All
records,
videos,
electronic

storage,
documents,
tapes,
and
other
information
or
material,
4
stored
or
preserved
in
any
medium
by
the
board,
administrator,
5
department,
or
any
other
entity
on
behalf
of
the
state
shall
be
6
considered
public
records
as
defined
in
chapter
22
and
subject
7
to
examination
as
provided
in
section
22.2
unless
otherwise
8
deemed
confidential
under
the
provisions
of
section
22.7.

SUBSECTION
.
9B.
The
board,
administrator,
department,
10
or
any
other
entity
on
behalf
of
the
state
shall
not
enforce
11
the
rights
of
the
board
with
respect
to
any
copyright,
12
trademark,
or
other
intellectual
property
right
of
the
board
13
contained
in
a
public
record
identified
in
subsection
9A
more
14
than
ten
years
after
the
public
record
was
originally
created,
15
produced,
filmed,
or
developed.

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
18
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
relates
to
public
records
of
the
Iowa
public
20
broadcasting
board.
The
bill
provides
that
all
records,
21
videos,
electronic
storage,
documents,
tapes,
and
other
22
information
or
material
kept
in
any
medium
by
the
Iowa
public
23
broadcasting
board,
administrator
of
the
public
broadcasting
24
division
of
the
department
of
education,
department
of
25
education,
or
any
other
entity
on
behalf
of
the
state
of
Iowa
26
shall
be
public
records
and
subject
to
examination
unless
27
deemed
confidential
under
Code
chapter
22
(Iowa’s
open
records
28
law).
29
The
bill
provides
that
the
Iowa
public
broadcasting
board,
30
administrator
of
the
public
broadcasting
division
of
the
31
department
of
education,
department
of
education,
or
any
other
32
entity
on
behalf
of
the
state
shall
not
enforce
the
rights

of
the
Iowa
public
broadcasting
board
with
respect
to
any

or
other
intellectual
property
right
