1.
Section
335.8,
subsection
1,
Code
2022,
is

amended
to
read
as
follows:

1.
In
order
to
avail
itself
of
the
powers
conferred
by
this
3
chapter,
the
board
of
supervisors
shall
appoint
a
commission
4
consisting
of
eligible
electors,
as
defined
in
section
39.3
,
5
who
reside
within
the
county,
but
outside
the
corporate
limits
6
of
any
city,
to
be
known
as
the
county
zoning
commission.
7
However,
in
a
county
with
a
population
of
less
than
twenty
8
thousand,
any
eligible
elector
who
resides
within
the
county
9
may
be
appointed
to
the
commission
regardless
of
whether
the
10
eligible
elector
resides
within
the
corporate
limits
of
a
11
city.
The
commission
may
recommend
the
boundaries
of
the
12
various
districts
and
appropriate
regulations
and
restrictions
13
to
be
enforced
in
the
districts.
The
commission
shall,
with
14
due
diligence,
prepare
a
preliminary
report
and
hold
public
15
hearings
on
the
preliminary
report
before
submitting
the
16
commission’s
final
report.
The
board
of
supervisors
shall
not
17
hold
its
public
hearings
or
take
action
until
it
has
received
18
the
final
report
of
the
commission.
After
the
adoption
of
19
the
regulations,
restrictions,
and
boundaries
of
districts,
20
the
zoning
commission
may,
from
time
to
time,
recommend
to
21
the
board
of
supervisors
amendments,
supplements,
changes,
or
22
modifications.
The
commission’s
report
and
any
recommendations
23
may
include
a
proposed
ordinance
or
amendments
to
an
ordinance.

This
bill
relates
to
the
composition
of
a
county
zoning

commission.
Under
current
law,
in
order
to
regulate
county
29
zoning
a
county
board
of
supervisors
shall
appoint
a
county
30
zoning
commission
that
consists
of
eligible
electors
who
reside
31
in
the
county,
but
outside
the
corporate
limits
of
any
city.
32
Under
the
bill,
an
eligible
elector
who
resides
in
a
county
33
with
a
population
of
less
than
20,000
may
be
appointed
to
the
34
county’s
zoning
commission
regardless
of
whether
the
eligible
