H.F. _____ Section 1. 2019 Iowa Acts, chapter 82, section 1, is amended 1 to read as follows: 2 SEC. 1. MEDICAID HOME AND COMMUNITY-BASED SERVICES BRAIN 3 INJURY WAIVER MAXIMUM. The department of human services shall 4 eliminate the monthly budget maximum or cap for individuals 5 eligible for the Medicaid home and community-based services 6 brain injury waiver. The department shall track the average 7 amount expended per waiver recipient each fiscal year beginning 8 July 1, 2019, and shall report the information annually to the 9 governor and the general assembly by October 1 December 30 . 10 Sec. 2. 2020 Iowa Acts, chapter 1053, section 1, is amended 11 to read as follows: 12 SEC. 1. MEDICAID HOME AND COMMUNITY-BASED SERVICES ELDERLY 13 WAIVER MAXIMUM. The department of human services shall 14 eliminate the monthly budget maximum or cap for individuals 15 eligible for the Medicaid home and community-based services 16 elderly waiver. The department shall track the average amount 17 expended per waiver recipient each fiscal year beginning July 18 1, 2020, and shall report the information annually to the 19 governor and the general assembly by October 1 December 30 . 20 EXPLANATION 21 The inclusion of this explanation does not constitute agreement with 22 the explanation’s substance by the members of the general assembly. 23 This bill changes the date by which the department of human 24 services is required to submit an annual report to the governor 25 and the general assembly regarding the average amount expended 26 per Medicaid waiver recipient for the elderly waiver and the 27 brain injury waiver each fiscal year from October 1 to December 28 30. 29 -1- LSB 5286YC (4) 89 pf/rh 1/ 1
