H.F. 9 Section 1. NEW SECTION . 915.36A Minor prosecuting witness 1 —— pretrial contact. 2 A prosecuting witness who is a minor, as defined in section 3 599.1, in a criminal case involving a public offense or a 4 delinquent act, other than a simple misdemeanor, shall have the 5 right to refuse a pretrial interview, pretrial deposition, or 6 any other discovery request involving direct contact with the 7 defendant. 8 EXPLANATION 9 The inclusion of this explanation does not constitute agreement with 10 the explanation’s substance by the members of the general assembly. 11 This bill relates to pretrial contact between a prosecuting 12 witness who is a minor and the defendant. 13 The bill provides that a prosecuting witness who is a 14 minor, as defined in Code section 599.1, in a criminal case 15 involving a public offense or a delinquent act, other than a 16 simple misdemeanor, shall have the right to refuse a pretrial 17 interview, pretrial deposition, or any other discovery request 18 involving direct contact with the defendant. 19 -1- LSB 1935YH (1) 89 as/rh 1/ 1
