GOALS AND ACCOUNTABILITY —— ECONOMIC DEVELOPMENT. 18 1. For the fiscal year beginning July 1, 2021, the goals 19 for the economic development authority shall be to expand and 20 stimulate the state economy, increase the wealth of Iowans, and 21 increase the population of the state. 22 2. To achieve the goals in subsection 1, the economic 23 development authority shall do all of the following for the 24 fiscal year beginning July 1, 2021: 25 a. Concentrate its efforts on programs and activities that 26 result in commercially viable products and services. 27 b. Adopt practices and services consistent with free 28 market, private sector philosophies. 29 c. Ensure economic growth and development throughout the 30 state. 31 d. Work with businesses and communities to continually 32 improve the economic development climate along with the 33 economic well-being and quality of life for Iowans. 34 e. Coordinate with other state agencies to ensure that they 35 -2- LSB 1002HV (1) 89 ko/tm 2/ 28
H.F. 871 are attentive to the needs of an entrepreneurial culture. 1 f. Establish a strong and aggressive marketing image to 2 showcase Iowa’s workforce, existing industry, and potential. 3 A priority shall be placed on recruiting new businesses, 4 business expansion, and retaining existing Iowa businesses. 5 Emphasis shall be placed on entrepreneurial development through 6 helping entrepreneurs secure capital, and developing networks 7 and a business climate conducive to entrepreneurs and small 8 businesses. 9 g. Encourage the development of communities and quality of 10 life to foster economic growth. 11 h. Prepare communities for future growth and development 12 through development, expansion, and modernization of 13 infrastructure. 14 i. Develop public-private partnerships with Iowa businesses 15 in the tourism industry, Iowa tour groups, Iowa tourism 16 organizations, and political subdivisions in this state to 17 assist in the development of advertising efforts. 18 j. Develop, to the fullest extent possible, cooperative 19 efforts for advertising with contributions from other sources. 20 Sec. 3. ECONOMIC DEVELOPMENT AUTHORITY. 21 1. APPROPRIATION 22 a. H.F. 871 (2) The full-time equivalent positions authorized under 1 this section are funded, in whole or in part, by the moneys 2 appropriated under this subsection or by other moneys received 3 by the authority, including certain federal moneys. 4 (3) For business development operations and programs, 5 international trade, export assistance, workforce recruitment, 6 and the partner state program. 7 (4) For transfer to a fund created pursuant to section 8 15.313 for purposes of financing strategic infrastructure 9 projects. 10 (5) For community economic development programs, tourism 11 operations, community assistance, plans for Iowa green corps 12 and summer youth programs, the main street and rural main 13 street programs, the school-to-career program, the community 14 development block grant, and housing and shelter-related 15 programs. 16 (6) For achieving the goals and accountability, and 17 fulfilling the requirements and duties required under this Act. 18 c. Notwithstanding section 8.33, moneys appropriated in 19 this subsection that remain unencumbered or unobligated at the 20 close of the fiscal year shall not revert but shall remain 21 available for expenditure for the purposes designated in this 22 subsection until the close of the succeeding fiscal year. 23 2. FINANCIAL ASSISTANCE RESTRICTIONS 24 a. A business creating jobs through moneys appropriated in 25 subsection 1 shall be subject to contract provisions requiring 26 new and retained jobs to be filled by individuals who are 27 citizens of the United States who reside within the United 28 States, or any person authorized to work in the United States 29 pursuant to federal law, including legal resident aliens 30 residing in the United States. 31 b. Any vendor who receives moneys appropriated in 32 subsection 1 shall adhere to such contract provisions and 33 provide periodic assurances as the state shall require that the 34 jobs are filled solely by citizens of the United States who 35 -4- LSB 1002HV (1) 89 ko/tm 4/ 28
H.F. 871 reside within the United States, or any person authorized to 1 work in the United States, pursuant to federal law, including 2 legal resident aliens residing in the United States. 3 c. A business that receives financial assistance from 4 the authority from moneys appropriated in subsection 1 shall 5 only employ individuals legally authorized to work in this 6 state. In addition to all other applicable penalties provided 7 by current law, all or a portion of the assistance received 8 by a business which is found to knowingly employ individuals 9 not legally authorized to work in this state is subject to 10 recapture by the authority. 11 3. USES OF APPROPRIATIONS 12 a. From the moneys appropriated in subsection 1, the 13 authority may provide financial assistance in the form of a 14 grant to a community economic development entity for conducting 15 a local workforce recruitment effort designed to recruit former 16 citizens of the state and former students at colleges and 17 universities in the state to meet the needs of local employers. 18 b. From the moneys appropriated in subsection 1, the 19 authority may provide financial assistance to early stage 20 industry companies being established by women entrepreneurs. 21 c. From the moneys appropriated in subsection 1, the 22 authority may provide financial assistance in the form of 23 grants, loans, or forgivable loans for advanced research and 24 commercialization projects involving value-added agriculture, 25 advanced technology, or biotechnology. 26 d. The authority shall not use any moneys appropriated in 27 subsection 1 for purposes of providing financial assistance for 28 the Iowa green streets pilot project or for any other program 29 or project that involves the installation of geothermal systems 30 for melting snow and ice from streets or sidewalks. 31 4. WORLD FOOD PRIZE 32 In lieu of the standing appropriation in section 15.368 33 there is appropriated from the general fund of the state to the 34 economic development authority for the fiscal year beginning 35 -5- LSB 1002HV (1) 89 ko/tm 5/ 28

There is appropriated from the Iowa skilled worker and 3 job creation fund created in section 8.75 to the Iowa economic 4 development authority for the fiscal year beginning July 1, 5 2021, and ending June 30, 2022, the following amount, or so 6 much thereof as is necessary, to be used for the purposes 7 designated: 8 For the funding of internships for students studying in the 9 fields of science, technology, engineering, and mathematics 10 with eligible Iowa employers as provided in section 15.411, 11 subsection 3, paragraph “c”: 12 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 750,000 13 b. FUTURE READY IOWA —— VOLUNTEER MENTORING PROGRAM 22 a. There is appropriated from the Iowa skilled worker and 23 job creation fund created in section 8.75 to the economic 24 development authority for the fiscal year beginning July 1, 25 2021, and ending June 30, 2022, the following amount, or so 26 much thereof as is necessary, to be used for the purpose 27 designated: 28 For allocation to the Iowa commission on volunteer services 29 to be used for establishing a volunteer mentor program to 30 support implementation of the future ready Iowa skilled 31 workforce last-dollar scholarship program in section 261.131 32 and the future ready Iowa skilled workforce grant program 33 created in section 261.132, and for not more than the following 34 full-time equivalent positions: 35 -8- LSB 1002HV (1) 89 ko/tm 8/ 28

The authority shall adopt rules pursuant to chapter 24 17A to establish criteria for the distribution of the moneys 25 appropriated in this subsection. 26 Sec. 4. LIMITATIONS OF STANDING APPROPRIATIONS —— FY 27 2021-2022. Notwithstanding the standing appropriations 28 in the following designated sections for the fiscal year 29 beginning July 1, 2021, and ending June 30, 2022, the amounts 30 appropriated from the general fund of the state pursuant to 31 these sections for the following purposes shall not exceed the 32 following amounts: 33 1. FINANCIAL ASSISTANCE REPORTING —— ECONOMIC 6 DEVELOPMENT AUTHORITY. The economic development authority and 7 the department of revenue shall submit a joint annual report 8 to the general assembly no later than November 1, 2021, that 9 details the amount of every direct loan, forgivable loan, 10 tax credit, tax exemption, tax refund, grant, or any other 11 financial assistance awarded to a person during the prior 12 fiscal year by the authority under an economic development 13 program administered by the authority. The report shall 14 identify the county where the project associated with each such 15 award is located. 16 Sec. 6. INSURANCE ECONOMIC DEVELOPMENT. From the 17 moneys collected by the insurance division in excess of the 18 anticipated gross revenues under section 505.7, subsection 19 3 , during the fiscal year beginning July 1, 2021, $100,000 20 shall be transferred to the economic development authority for 21 insurance economic development and international insurance 22 economic development. 23 Sec. 7. IOWA FINANCE AUTHORITY. 24 1. There is appropriated from the general fund of the state 25 to the Iowa finance authority for the fiscal year beginning 26 July 1, 2021, and ending June 30, 2022, the following amount, 27 or so much thereof as is necessary, to be used to provide 28 reimbursement for rent expenses to eligible persons under 29 the home and community-based services rent subsidy program 30 established in section 16.55: 31 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 658,000 32 2. PUBLIC EMPLOYMENT RELATIONS BOARD. 8 1. DIVISION OF WORKERS’ COMPENSATION 4 a. FTEs 26.10 9 b. The division of workers’ compensation shall charge a 10 $100 filing fee for workers’ compensation cases. The filing 11 fee shall be paid by the petitioner of a claim. However, 12 the fee can be taxed as a cost and paid by the losing party, 13 except in cases where it would impose an undue hardship or be 14 unjust under the circumstances. The moneys generated by the 15 filing fee allowed under this paragraph are appropriated to the 16 department of workforce development to be used for purposes of 17 administering the division of workers’ compensation. 18 3. WORKFORCE DEVELOPMENT OPERATIONS 19 a. Notwithstanding 15 section 96.9, subsection 4 , paragraph “a”, moneys credited to 16 the state by the secretary of the treasury of the United 17 States pursuant to section 903 of the Social Security 18 Act are appropriated to the department of workforce 19 development and shall be used by the department for the 20 administration of the unemployment compensation program only. 21 This appropriation shall not apply to any fiscal year 22 beginning after December 31, 2021. 23 Sec. 17. IOWA SKILLED WORKER AND JOB CREATION FUND. 24 1. CONTINGENT EFFECTIVE DATE. The following takes 4 effect on the effective date of 2021 Iowa Acts, House File 857, 5 if enacted: 6 The sections of this division of this Act appropriating 7 moneys to the economic development authority for purposes of a 8 butchery innovation and revitalization program. 9 DIVISION III 10 FIBEROPTIC NETWORK CONDUIT INSTALLATION AND CERTIFICATION 11 PROGRAM 12 Sec. 22. Section 8B.25, subsection 2, Code 2021, is amended 13 to read as follows: 14 2. The office shall lead and coordinate a program to provide 15 for the installation of fiberoptic network conduit where such 16 conduit does not exist. The chief information officer shall 17 consult and coordinate with applicable agencies and entities , 18 including public utilities as defined in section 476.1, the 19 state department of transportation, the economic development 20 authority, county boards of supervisors, municipal governing 21 bodies, the farm-to-market review board, county conservation 22 boards, and the boards, commissions, or agencies in control 23 of state parks, as determined appropriate to ensure that the 24 opportunity is provided to lay or install fiberoptic network 25 conduit wherever a state-funded construction project involves 26 trenching, boring, a bridge, a roadway, or opening of the 27 ground, or alongside any state-owned infrastructure. 28 Sec. 23. NEW SECTION . 15E.167 Broadband forward and 29 telecommuter forward —— certifications. 30 1. As used in this section, unless the context requires 31 otherwise: 32 a. “Broadband” means the same as defined in section 8B.1. 33 b. “Broadband infrastructure” means the same as defined in 34 section 8B.1. 35 -22- LSB 1002HV (1) 89 ko/tm 22/ 28
H.F. 871 c. “Communications service provider” means a service 1 provider that provides broadband service. 2 d. “Political subdivision” means a city, county, or 3 township. 4 2. The authority shall establish the following 5 certification programs: 6 a. Broadband forward certification, with the objective of 7 encouraging political subdivisions to further develop broadband 8 infrastructure and access to broadband. 9 b. Telecommuter forward certification, with the objective 10 of encouraging political subdivisions to further develop and 11 promote the availability of telecommuting. 12 3. To obtain broadband forward certification, a political 13 subdivision shall submit to the authority, on forms prescribed 14 by the authority by rule, an application indicating the 15 following: 16 a. The political subdivision’s support and commitment to 17 promote the availability of broadband. 18 b. Existing or proposed ordinances encouraging the 19 further development of broadband infrastructure and access to 20 broadband. 21 c. Efforts to secure local funding for the further 22 development of broadband infrastructure and access to 23 broadband. 24 d. A single point of contact for all matters related to 25 broadband and broadband infrastructure. 26 4. A single point of contact designated in an application 27 submitted pursuant to subsection 3 shall be responsible for all 28 of the following: 29 a. Coordination and partnership with the authority, 30 communications service providers, realtors, economic 31 development professionals, employers, employees, and other 32 broadband stakeholders. 33 b. Collaboration with the authority, communication service 34 providers, and employers to identify, develop, and market 35 -23- LSB 1002HV (1) 89 ko/tm 23/ 28
H.F. 871 broadband packages available in the political subdivision. 1 c. Familiarity with broadband mapping tools and other 2 state-level resources. 3 d. Maintaining regular communication with the authority. 4 e. Providing to the political subdivision regular reports 5 regarding the availability of broadband in the political 6 subdivision. 7 5. A political subdivision that the authority has certified 8 as a broadband forward community under subsection 3 shall not 9 do any of the following: 10 a. Require an applicant to designate a final contractor to 11 complete a broadband infrastructure project. 12 b. Impose a fee to review an application or issue a permit 13 for a broadband infrastructure application in excess of one 14 hundred dollars. 15 c. Impose a moratorium of any kind on the approval 16 of applications and issuance of permits for broadband 17 infrastructure projects or on construction related to broadband 18 infrastructure. 19 d. Discriminate among communications service providers, 20 or public utilities with respect to any action described in 21 this section or otherwise related to broadband infrastructure, 22 including granting access to public rights-of-way, 23 infrastructure and poles, river and bridge crossings, or any 24 other physical assets owned or controlled by the political 25 subdivision. 26 e. As a condition for approving an application or issuing a 27 permit for a broadband infrastructure project or for any other 28 purpose, require the applicant to do any of the following: 29 (1) Provide any service or make available any part of the 30 broadband infrastructure to the political subdivision. 31 (2) Except for the fee allowed under paragraph “b” of this 32 subsection, make any payment to or on behalf of the political 33 subdivision. 34 6. To obtain telecommuter forward certification, a 35 -24- LSB 1002HV (1) 89 ko/tm 24/ 28
H.F. 871 political subdivision shall submit to the authority, on forms 1 prescribed by the authority by rule, an application indicating 2 the following: 3 a. The political subdivision’s support and commitment to 4 promote the availability of telecommuting options. 5 b. Existing or proposed ordinances encouraging the further 6 development of telecommuting options. 7 c. Efforts to secure local funding for the further 8 development of telecommuting options. 9 d. A single point of contact for coordinating telecommuting 10 opportunities and options: 11 7. A single point of contact designated in an application 12 submitted pursuant to subsection 6 shall be responsible for all 13 of the following: 14 a. Coordination and partnership with the authority, 15 communications service providers, realtors, economic 16 development professionals, employers, employees, and other 17 telecommuting stakeholders. 18 b. Collaboration with the authority, communication service 19 providers, and employers to identify, develop, and market 20 telecommuter-capable broadband packages available in the 21 political subdivision. 22 c. Promotion of telecommuter-friendly workspaces, such 23 as business incubators with telecommuting spaces, if such a 24 workspace has been established in the political subdivision at 25 the time the political subdivision submits the application. 26 d. Familiarity with broadband mapping tools and other 27 state-level resources. 28 e. Maintaining regular communication with the authority. 29 f. Providing to the political subdivision regular reports 30 regarding the availability of telecommuting options in the 31 political subdivision. 32 8. The authority shall develop criteria for evaluating an 33 application for both forms of certification and the awarding 34 of certificates. The authority shall consult 2 with local government entities and local economic development 3 officials when evaluating an application. 4 9. The authority shall adopt rules pursuant to chapter 17A 5 for the implementation of this section. 6 EXPLANATION 7 The inclusion of this explanation does not constitute agreement with 8 the explanation’s substance by the members of the general assembly. 9 DIVISION I —— FY 2021–2022 APPROPRIATIONS. This bill 10 appropriates moneys for the fiscal year 2021-2022 from the 11 general fund of the state to the department of cultural 12 affairs, the economic development authority, the Iowa 13 finance authority, the public employment relations board, the 14 department of workforce development, Iowa state university of 15 science and technology, the state university of Iowa, and the 16 university of northern Iowa. 17 The bill appropriates moneys for the fiscal year 2021-2022 18 from the Iowa skilled worker and job creation fund created in 19 Code section 8.75 to the economic development authority, the 20 department of workforce development, and the state board of 21 regents and institutions under the control of the board. 22 For the fiscal year 2021-2022, the bill limits standing 23 appropriations established in the Code for the world food 24 prize, certain operational support grants, community cultural 25 grants, and regional tourism marketing. 26 The bill transfers $100,000 of the moneys collected by the 27 insurance division in excess of the anticipated gross revenues 28 under Code section 505.7 to the economic development authority. 29 The bill appropriates moneys for the fiscal year 2021-2022 30 from the special employment security contingency fund to the 31 department of workforce development. 32 The bill appropriates interest earned on the unemployment 33 compensation reserve fund for the fiscal year 2021-2022 to the 34 department of workforce development. 35 -26- LSB 1002HV (1) 89 ko/tm 26/ 28
H.F. 871 Moneys credited to the state by the secretary of treasury 1 of the United States pursuant to section 903 of the Social 2 Security Act are appropriated to the department of workforce 3 development. 4 The auditor of state is requested to review the audit of the 5 Iowa finance authority performed by the auditor hired by the 6 authority. 7 The bill requires the economic development authority and the 8 department of revenue to submit a joint annual report to the 9 general assembly by November 1, 2021, detailing all financial 10 assistance awarded in the prior fiscal year. 11 DIVISION II —— FY 2021-2022 CONTINGENT APPROPRIATIONS. The 12 bill appropriates moneys for the fiscal year 2021-2022 from the 13 Iowa skilled worker and job creation fund and from the general 14 fund of the state to the economic development authority for the 15 butchery innovation and revitalization program, contingent on 16 the enactment of 2021 Iowa Acts, House File 857. 17 DIVISION III —— FIBEROPTIC NETWORK CONDUIT INSTALLATION 18 AND CERTIFICATION PROGRAM. The bill provides that the 19 office of the chief information officer is to administer a 20 fiberoptic network conduit installation program related to the 21 installation of fiberoptic network conduit where such conduit 22 does not exist. More specifically, the office is to coordinate 23 with applicable agencies and entities to ensure there is an 24 opportunity to install fiberoptic network conduit during 25 certain state-funded projects. 26 The bill also provides that a political subdivision is 27 to apply to the economic development authority for broadband 28 forward certification or telecommuter forward certification on 29 forms prescribed by the authority by rule. The bill requires 30 the authority to develop criteria for evaluating applications 31 for broadband forward certification and telecommuter forward 32 certification. The bill provides that such criteria must 33 take into account the applicant’s individual circumstances 34 and economic goals.
