H.F. 862 DIVISION I 1 REBUILD IOWA INFRASTRUCTURE FUND 2 Section 1. REBUILD IOWA INFRASTRUCTURE FUND —— 3 APPROPRIATIONS. There is appropriated from the rebuild Iowa 4 infrastructure fund to the following departments and agencies 5 for the following fiscal years, the following amounts, or so 6 much thereof as is necessary, to be used for the purposes 7 designated: 8 1. (1) The moneys appropriated in this subsection shall 25 be used to support demonstration projects in subwatersheds as 26 designated by the department that are part of high-priority 27 watersheds identified by the water resources coordinating 28 council. 29 (2) The moneys appropriated in this subsection shall be 30 used to support demonstration projects in watersheds generally, 31 including regional watersheds, as designated by the division 32 and high-priority watersheds identified by the water resources 33 coordinating council. 34 c. In supporting projects in watersheds and subwatersheds 35 -1- LSB 1008HV (2) 89 ec/tm 1/ 13
H.F. 862 as provided in paragraph “b”, all of the following shall apply: 1 (1) The demonstration projects shall utilize water quality 2 practices as described in the latest revision of the document 3 entitled “Iowa Nutrient Reduction Strategy” initially presented 4 in November 2012 by the department of agriculture and land 5 stewardship, the department of natural resources, and Iowa 6 state university of science and technology. 7 (2) The division shall implement demonstration projects as 8 provided in subparagraph (1) by providing for participation by 9 persons who hold a legal interest in agricultural land used in 10 farming. To every extent practical, the division shall provide 11 for collaborative participation by such persons who hold a 12 legal interest in agricultural land located within the same 13 subwatershed. 14 (3) The division shall implement demonstration projects on 15 a cost-share basis as determined by the division. Except for 16 edge-of-field practices, the state’s share of the amount shall 17 not exceed 50 percent of the estimated cost of establishing the 18 practice as determined by the division or 50 percent of the 19 actual cost of establishing the practice, whichever is less. 20 (4) The demonstration projects shall be used to educate 21 other persons about the feasibility and value of establishing 22 similar water quality practices. The division shall promote 23 field day events for purposes of allowing interested persons to 24 establish water quality practices on their agricultural land. 25 (5) The division shall conduct water quality evaluations 26 within supported subwatersheds. Within a reasonable period 27 after accumulating information from such evaluations, the 28 division shall create an aggregated database of water quality 29 practices. Any information identifying a person holding a 30 legal interest in agricultural land or specific agricultural 31 land shall be a confidential record. 32 d. The moneys appropriated in this subsection shall be used 33 to support education and outreach in a manner that encourages 34 persons who hold a legal interest in agricultural land used for 35 -2- LSB 1008HV (2) 89 ec/tm 2/ 13
H.F. 862 farming to implement water quality practices, including the 1 establishment of such practices in watersheds generally, and 2 not limited to subwatersheds or high-priority watersheds. 3 e. The moneys appropriated in this subsection may be used 4 to contract with persons to coordinate the implementation of 5 efforts provided in this subsection. 6 f. The moneys appropriated in this subsection may be used 7 by the department to support urban soil and water conservation 8 efforts, which may include but are not limited to management 9 practices related to bioretention, landscaping, the use of 10 permeable or pervious pavement, and soil quality restoration. 11 The moneys shall be allocated on a cost-share basis as provided 12 in chapter 161A . 13 g. Notwithstanding any other provision of law to the 14 contrary, the department may use moneys appropriated in this 15 subsection to carry out the provisions of this subsection on a 16 cost-share basis in combination with other moneys available to 17 the department from a state or federal source. 18 h. Not more than 10 percent of the moneys appropriated in 19 this subsection may be used for costs of administration and 20 implementation of the water quality initiative administered by 21 the soil conservation division. 22 3. There is appropriated from the general fund of the state 1 to the technology reinvestment fund for the following fiscal 2 years, the sum of seventeen million five hundred thousand 3 dollars to the technology reinvestment fund following amounts : 4 (1) The For the fiscal year beginning July 1, 2014, and 5 ending June 30, 2015 , the sum of seventeen million five hundred 6 thousand dollars . 7 (2) For the fiscal year beginning July 1, 2021, and ending 8 June 30, 2022, the sum of thirty-five million dollars. 9 (2) (3) The For the fiscal year beginning July 1, 2021 10 2022 , and for each subsequent fiscal year thereafter , the sum 11 of seventeen million five hundred thousand dollars . 12 Sec. 7. Section 15.261, subsection 2, Code 2021, is amended 13 to read as follows: 14 2. Moneys in the vacant state buildings demolition fund 15 are appropriated to the authority for purposes of funding a 16 grant program for the demolition of vacant buildings owned by 17 the state which are no longer used for a state purpose. Grant 18 program criteria shall provide that no more than fifty percent 19 of the cost of a project for the demolition of vacant buildings 20 shall be funded from a grant under the program. 21 EXPLANATION 22 The inclusion of this explanation does not constitute agreement with 23 the explanation’s substance by the members of the general assembly. 24 This bill relates to and makes appropriations to state 25 departments and agencies from the rebuild Iowa infrastructure 26 fund and the technology reinvestment fund, and provides for 27 related matters. The bill is organized by divisions. 28 DIVISION I —— REBUILD IOWA INFRASTRUCTURE FUND. This 29 division appropriates project funding for FY 2021-2022 from 30 the rebuild Iowa infrastructure fund for projects for the 31 departments of agriculture and land stewardship, blind, 32 cultural affairs, human services, natural resources, public 33 defense, public safety, and transportation, and for the board 34 of regents, treasurer of state, and judicial branch. H.F. 862 division also appropriates project funding from the rebuild 1 Iowa infrastructure fund for multiple fiscal years to the 2 departments of administrative services, and corrections, the 3 economic development authority, and the legislative branch. 4 DIVISION II —— TECHNOLOGY REINVESTMENT FUND. This 5 division appropriates project funding for FY 2021-2022 6 from the technology reinvestment fund for the departments 7 of corrections, education, homeland security and emergency 8 management, human rights, human services, inspections and 9 appeals, management, public defense, public safety, revenue, 10 and veterans affairs, and for the judicial branch, the office 11 of the chief information officer, and for the ethics and 12 campaign disclosure board. 13 DIVISION III —— CHANGES TO PRIOR APPROPRIATIONS. This 14 division makes a change to moneys appropriated to the economic 15 development authority for deposit in the vacant state buildings 16 demolition fund and the vacant state buildings rehabilitation 17 fund for FY 2021-2022. The division provides that the 18 authority shall give priority to new recipients. 19 DIVISION IV —— MISCELLANEOUS PROVISIONS. Code section 20 8.57C, concerning the technology reinvestment fund, is amended 21 to provide that the standing appropriation to the fund from the 22 general fund for fiscal years beginning on or after July 1, 23 2021, is changed to fiscal years beginning on or after July 1, 24 2022, and to provide for an appropriation to the fund from the 25 general fund for the fiscal year beginning July 1, 2021, of $35 26 million. 27 Code section 15.261, concerning the vacant state buildings 28 demolition fund, is amended to provide that no more than 50 29 percent of the cost of a project for the demolition of vacant 30 buildings shall be funded from a grant from the fund. 31 -13- LSB 1008HV (2) 89 ec/tm 13/ 13
