FARMERS WITH DISABILITIES PROGRAM. 9 1. The moneys appropriated in subsection 1 shall be used for 18 the public purpose of providing a grant to a national nonprofit 19 organization with over 80 years of experience in assisting 20 children and adults with disabilities and special needs. The 21 moneys shall be used to support a nationally recognized program 22 that began in 1986 and has been replicated in at least 30 other 23 states, but which is not available through any other entity 24 in this state, and that provides assistance to farmers with 25 disabilities in all 99 counties to allow the farmers to remain 26 in their own homes and be gainfully engaged in farming through 27 provision of agricultural worksite and home modification 28 consultations, peer support services, services to families, 29 information and referral, and equipment loan services. 30 3. Notwithstanding section 8.33 , moneys appropriated in 31 this section that remain unencumbered or unobligated at the 32 close of the fiscal year shall not revert but shall remain 33 available for expenditure for the purposes designated until the 34 close of the succeeding fiscal year. 35 -4- LSB 1001HV (1) 89 da/tm 4/ 27

H.F. 860 DIVISION II 1 GENERAL FUND 2 DEPARTMENT OF AGRICULTURE AND LAND STEWARDSHIP 3 WATER QUALITY INITIATIVE 4 Sec. 12. WATER QUALITY INITIATIVE —— GENERAL. 5 1. There is appropriated from the general fund of the state 6 to the department of agriculture and land stewardship for the 7 fiscal year beginning July 1, 2021, and ending June 30, 2022, 8 the following amount, or so much thereof as is necessary, to be 9 used for the purposes designated: 10 For deposit in the water quality initiative fund created in 11 section 466B.45 , for purposes of supporting the water quality 12 initiative administered by the division of soil conservation 13 and water quality as provided in section 466B.42 , including 14 salaries, support, maintenance, and miscellaneous purposes: 15 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 3,000,000 16 2. a. The moneys appropriated in subsection 1 shall be 17 used to support projects in subwatersheds as designated by the 18 division that are part of high-priority watersheds identified 19 by the water resources coordinating council established 20 pursuant to section 466B.3 . 21 b. The moneys appropriated in subsection 1 shall be used to 22 support projects in watersheds generally, including regional 23 watersheds, as designated by the division and high-priority 24 watersheds identified by the water resources coordinating 25 council established pursuant to section 466B.3. 26 3. In supporting projects in subwatersheds and watersheds 27 as provided in subsection 2, all of the following shall apply: 28 a. The demonstration projects shall utilize water quality 29 practices as described in the Iowa nutrient reduction strategy 30 as defined in section 455B.171 . 31 b. The division shall implement demonstration projects as 32 provided in paragraph “a” by providing for participation by 33 persons who hold a legal interest in agricultural land used in 34 farming. To every extent practical, the division shall provide 35 -6- LSB 1001HV (1) 89 da/tm 6/ 27
H.F. 860 for collaborative participation by such persons who hold a 1 legal interest in agricultural land located within the same 2 subwatershed. 3 c. The division shall implement a demonstration project on 4 a cost-share basis as determined by the division. However, 5 except for edge-of-field practices, the state’s share of the 6 amount shall not exceed 50 percent of the estimated cost of 7 establishing the practice as determined by the division or 8 50 percent of the actual cost of establishing the practice, 9 whichever is less. 10 d. The demonstration projects shall be used to educate other 11 persons about the feasibility and value of establishing similar 12 water quality practices. The division shall promote field day 13 events for purposes of allowing interested persons to establish 14 water quality practices on their agricultural land. 15 e. The division shall conduct water quality evaluations 16 within supported subwatersheds. Within a reasonable period 17 after accumulating information from such evaluations, the 18 division shall create an aggregated database of water quality 19 practices. Any information identifying a person holding a 20 legal interest in agricultural land or specific agricultural 21 land shall be a confidential record under section 22.7 . 22 4. The moneys appropriated in subsection 1 shall be used 23 to support education and outreach in a manner that encourages 24 persons who hold a legal interest in agricultural land used for 25 farming to implement water quality practices, including the 26 establishment of such practices in watersheds generally, and 27 not limited to subwatersheds or high-priority watersheds. 28 5. The moneys appropriated in subsection 1 may be used 29 to contract with persons to coordinate the implementation of 30 efforts provided in this section. 31 6. The moneys appropriated in subsection 1 may be used by 32 the department to support urban soil and water conservation 33 efforts, which may include but are not limited to management 34 practices related to bioretention, landscaping, the use of 35 -7- LSB 1001HV (1) 89 da/tm 7/ 27
H.F. 860 permeable or pervious pavement, and soil quality restoration. 1 The moneys shall be allocated on a cost-share basis as provided 2 in chapter 161A. 3 7. Notwithstanding any other provision of law to the 4 contrary, the department may use moneys appropriated in 5 subsection 1 to carry out the provisions of this section on a 6 cost-share basis in combination with other moneys available to 7 the department from a state or federal source. 8 8. Not more than 10 percent of the moneys appropriated in 9 this section may be used to pay for the costs of administering 10 and implementing the water quality initiative by the 11 department’s division of soil conservation and water quality as 12 provided in section 466B.42 and this section. 13 DIVISION III 14 DEPARTMENT OF NATURAL RESOURCES 15 Sec. 13. GENERAL FUND —— DEPARTMENT. 16 1. STATE FISH AND GAME PROTECTION FUND —— REGULATION 9 AND ADVANCEMENT OF OUTDOOR ACTIVITIES. 10 1. There is appropriated from the state fish and game 11 protection fund created pursuant to section 456A.17 to the 12 department of natural resources for the fiscal year beginning 13 July 1, 2021, and ending June 30, 2022, the following amount, 14 or so much thereof as is necessary, to be used for the purposes 15 designated: 16 For purposes of supporting the regulation or advancement of 17 hunting, fishing, or trapping, or the protection, propagation, 18 restoration, management, or harvest of fish or wildlife, 19 including for administration, regulation, law enforcement, and 20 programs; and for salaries, support, maintenance, equipment, 21 and miscellaneous purposes: 22 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 46,273,501 23 2. Notwithstanding section 455A.10 , the department may use 24 the unappropriated balance remaining in the state fish and game 25 protection fund to provide for the funding of health and life 26 insurance premium payments from unused sick leave balances of 27 conservation peace officers employed in a protection occupation 28 who retire, pursuant to section 97B.49B . 29 3. VISITOR PARKING AT STATE PARKS —— STUDY. The 11 department of natural resources shall conduct a study of the 12 availability of visitor parking at state parks. The department 13 shall identify any inadequacy in the availability of visitor 14 parking at each state park during periods of high use. The 15 department shall prepare a report which shall identify each 16 state park that fails to provide adequate visitor parking and 17 a recommendation to improve that state park to accommodate 18 existing or expected visitor parking. The department shall 19 submit the report to the governor and general assembly not 20 later than December 10, 2021. 21 DIVISION IV 22 IOWA STATE UNIVERSITY 23 SPECIAL GENERAL FUND APPROPRIATIONS 24 Sec. 22. VETERINARY DIAGNOSTIC LABORATORY. 25 1. Paragraph “a” does not apply to a reduction made to 6 support the college of veterinary medicine, if the same 7 percentage of reduction imposed on the college of veterinary 8 medicine is also imposed on all of Iowa state university of 9 science and technology’s budget units. 10 3. If by June 30, 2022, Iowa state university of science and 11 technology fails to allocate the moneys appropriated in this 12 section to the college of veterinary medicine in accordance 13 with this section, the moneys appropriated in this section for 14 that fiscal year shall revert to the general fund of the state. 15 Sec. 23. LIVESTOCK DISEASE RESEARCH. Subsection 1 does not apply to moneys transferred 28 pursuant to this division of this Act to the loess hills 29 development and conservation fund created in section 161D.2 30 which shall not revert as provided in that section. 31 DIVISION VII 32 ENVIRONMENT FIRST FUND 33 SPECIAL APPROPRIATIONS 34 Sec. 30. The moneys appropriated in subsection 1 shall be used to 19 support projects in watersheds generally, including regional 20 watersheds, as designated by the division and high-priority 21 watersheds identified by the water resources coordinating 22 council established pursuant to section 466B.3. 23 3. In supporting projects in subwatersheds and watersheds 24 as provided in subsection 2, all of the following shall apply: 25 a. The demonstration projects shall utilize water quality 26 practices as described in the Iowa nutrient reduction strategy 27 as defined in section 455B.171 . 28 b. The division shall implement demonstration projects as 29 provided in paragraph “a” by providing for participation by 30 persons who hold a legal interest in agricultural land used in 31 farming. To every extent practical, the division shall provide 32 for collaborative participation by such persons who hold a 33 legal interest in agricultural land located within the same 34 subwatershed. 35 -21- LSB 1001HV (1) 89 da/tm 21/ 27
H.F. 860 c. The division shall implement a demonstration project on 1 a cost-share basis as determined by the division. However, 2 except for edge-of-field practices, the state’s share of the 3 amount shall not exceed 50 percent of the estimated cost of 4 establishing the practice as determined by the division or 5 50 percent of the actual cost of establishing the practice, 6 whichever is less. 7 d. The demonstration projects shall be used to educate other 8 persons about the feasibility and value of establishing similar 9 water quality practices. The division shall promote field day 10 events for purposes of allowing interested persons to establish 11 water quality practices on their agricultural land. 12 e. The division shall conduct water quality evaluations 13 within supported subwatersheds. Within a reasonable period 14 after accumulating information from such evaluations, the 15 division shall create an aggregated database of water quality 16 practices. Any information identifying a person holding a 17 legal interest in agricultural land or specific agricultural 18 land shall be a confidential record under section 22.7 . 19 4. The moneys appropriated in subsection 1 shall be used 20 to support education and outreach in a manner that encourages 21 persons who hold a legal interest in agricultural land used for 22 farming to implement water quality practices, including the 23 establishment of such practices in watersheds generally, and 24 not limited to subwatersheds or high-priority watersheds. 25 5. The moneys appropriated in subsection 1 may be used 26 to contract with persons to coordinate the implementation of 27 efforts provided in this section. 28 6. The moneys appropriated in subsection 1 may be used by 29 the department to support urban soil and water conservation 30 efforts, which may include but are not limited to management 31 practices related to bioretention, landscaping, the use of 32 permeable or pervious pavement, and soil quality restoration. 33 The moneys shall be allocated on a cost-share basis as provided 34 in chapter 161A. 35 -22- LSB 1001HV (1) 89 da/tm 22/ 27

Notwithstanding any other provision of law to the 1 contrary, the department may use moneys appropriated in 2 subsection 1 to carry out the provisions of this section on a 3 cost-share basis in combination with other moneys available to 4 the department from a state or federal source. 5 8. Not more than 10 percent of the moneys appropriated in 6 this section may be used to pay for the costs of administering 7 and implementing the water quality initiative by the 8 department’s division of soil conservation and water quality as 9 provided in section 466B.42 and this section. 10 DIVISION VIII 11 IOWA RESOURCES ENHANCEMENT AND PROTECTION FUND 12 Sec. 31. REAP —— IN LIEU OF GENERAL FUND APPROPRIATION. In 13 lieu of the standing appropriation in section 455A.18 , there is 14 appropriated from the environment first fund created in section 15 8.57A to the Iowa resources enhancement and protection fund 16 for the fiscal year beginning July 1, 2021, and ending June 17 30, 2022, the following amount, to be allocated as provided in 18 section 455A.19 : 19 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 12,000,000 20 Sec. 32. REAP —— OPEN SPACES ACCOUNT —— STATE PARK 21 MAINTENANCE AND REPAIR. Notwithstanding section 455A.19, 22 subsection 1, paragraph “a”, subparagraph (1), of the moneys 23 allocated to the open spaces account of the Iowa resources 24 enhancement and protection fund, up to $1,000,000 may be 25 used by the department of natural resources for state park 26 maintenance and repair for the fiscal year beginning July 1, 27 2021, and ending on June 30, 2022. 28 DIVISION IX 29 CODE CHANGES 30 Sec. 33. NEW SECTION . 159A.17 Appropriation. 31 For the fiscal year beginning July 1, 2021, and ending 32 June 30, 2022, and for each fiscal year thereafter, there 33 is appropriated from the general fund of the state to the 34 renewable fuel infrastructure fund created in section 159A.16 35 -23- LSB 1001HV (1) 89 da/tm 23/ 27
H.F. 860 the amount of eleven million dollars. 1 Sec. 34. Section 455A.18, subsection 3, paragraph a, Code 2 2021, is amended to read as follows: 3 a. For each fiscal year of the fiscal period beginning 4 July 1, 1997, and ending June 30, 2023 2026 , there is 5 appropriated from the general fund, to the Iowa resources 6 enhancement and protection fund, the amount of twenty million 7 dollars, to be used as provided in this chapter . However, 8 in any fiscal year of the fiscal period, if moneys from the 9 lottery are appropriated by the state to the fund, the amount 10 appropriated under this subsection shall be reduced by the 11 amount appropriated from the lottery. 12 Sec. 35. CONTINGENT EFFECTIVE DATE. The section of this 13 division of this Act enacting section 159A.17 takes effect 14 upon the enactment of 2021 Iowa Acts, Senate File 549 or 15 its successor, if enacted, or House Study Bill 185 or its 16 successor, if enacted. 17 EXPLANATION 18 The inclusion of this explanation does not constitute agreement with 19 the explanation’s substance by the members of the general assembly. 20 GENERAL. This bill relates to agriculture and natural 21 resources by making appropriations for the fiscal year 22 2021-2022 to support related entities, including the department 23 of agriculture and land stewardship (DALS), the department of 24 natural resources (DNR), and Iowa state university (ISU), and 25 the university of Iowa (UI). 26 The bill primarily appropriates moneys to DALS and DNR. 27 The appropriations are made to support those departments for 28 administration, regulation, and support of programs. The bill 29 requires the departments to submit quarterly reports to the 30 general assembly and department of management regarding the 31 expenditure of appropriated moneys. The bill also provides 32 moneys to support specific programs or projects administered 33 by those departments. The bill appropriates moneys from a 34 number of sources, including the general fund of the state 35 -24- LSB 1001HV (1) 89 da/tm 24/ 27
H.F. 860 (general fund), the state fish and game protection fund, the 1 groundwater protection fund, and the environment first fund 2 (EFF). Appropriations are made from a number of sources to 3 support the water quality initiative (WQI). 4 The bill is organized into divisions. 5 DALS —— GENERAL FUND APPROPRIATIONS. The bill appropriates 6 moneys to DALS from the general fund in order to support its 7 administrative divisions, including consumer protection and 8 industry services, soil conservation, and food safety and 9 animal health. Moneys are transferred to ISU to support its 10 midwest grape and wine institute. 11 DALS —— MISCELLANEOUS FUNDS —— DESIGNATED APPROPRIATIONS. 12 The bill appropriates moneys from several sources to support a 13 number of designated purposes, including moneys derived from 14 unclaimed winnings from horse and dog races, for administration 15 and enforcement of racing regulations; and moneys credited 16 to the renewable fuel infrastructure fund, for purposes of 17 regulating motor fuel. 18 DALS —— SPECIAL GENERAL FUND APPROPRIATIONS. The bill 19 makes special appropriations from the general fund to DALS in 20 order to support specific purposes including milk inspection, 21 the local food and farm program, an agricultural education 22 organization, foreign animal disease preparedness, assistance 23 to farmers with disabilities, loess hills protections, grain 24 regulation, and a value added agriculture grant program. 25 DALS —— GENERAL FUND APPROPRIATIONS —— WATER QUALITY. H.F. 860 DNR —— MISCELLANEOUS FUNDS —— DESIGNATED APPROPRIATIONS. 1 The bill appropriates moneys to DNR from a number of sources 2 to support designated purposes, including moneys deposited in 3 the special snowmobile fund to provide for administering and 4 enforcing the state snowmobile programs; and moneys deposited 5 in the unassigned revenue fund for purposes of paying for 6 administration of DNR’s underground storage tanks section. 7 DNR —— SPECIAL GENERAL FUND APPROPRIATIONS. The bill makes 8 special appropriations from the general fund to DNR in order 9 to support specific purposes including floodplain management, 10 dam safety and forestry health management programs, and state 11 parks. 12 DNR —— MISCELLANEOUS PROVISIONS. The bill requires the DNR 13 to conduct a study of the availability of visitor parking at 14 state parks. DNR must submit a report regarding its findings 15 and recommendations by December 10, 2021. 16 ISU —— SPECIAL GENERAL FUND APPROPRIATIONS. The bill 17 appropriates moneys from the general fund to ISU to support the 18 operation of its veterinary diagnostic laboratory and livestock 19 disease research. The bill also supports efforts for hosting 20 the national association of county agricultural agents. 21 UI —— SPECIAL GENERAL FUND APPROPRIATIONS. The bill makes 22 appropriations from the general fund to UI to support the 23 operations of Iowa’s center for agricultural safety and health 24 which is part of UI’s college of public health. 25 DALS, DNR, AND UI —— EFF —— GENERAL APPROPRIATIONS. The 26 bill appropriates moneys from the EFF to support a number of 27 programs administered by DALS, DNR, and UI. For DALS, the 28 moneys are appropriated to support programs involving soil 29 conservation, watershed protection and nutrient management, 30 and the loess hills development and conservation fund. For 31 DNR, moneys are appropriated to support programs involving 32 state parks, geographic information systems, water quality 33 monitoring, public water supplies, regulation of animal feeding 34 operations, air quality, and floodplain management and dam 35 -26- LSB 1001HV (1) 89 da/tm 26/ 27
H.F. 860 safety. For UI, moneys are appropriated to support the Iowa 1 geological survey. The bill includes provisions that delay the 2 reversion of these moneys. 3 EFF —— SPECIAL APPROPRIATIONS FOR WQI. The bill 4 appropriates moneys from the EFF to the water quality 5 initiative fund subject to the same conditions applicable to 6 moneys appropriated to the fund from the general fund. 7 IOWA RESOURCES ENHANCEMENT AND PROTECTION (REAP) FUND —— EFF 8 APPROPRIATION IN LIEU OF GENERAL FUND APPROPRIATION. An amount 9 of moneys is appropriated from the EFF to the REAP fund instead 10 of the $20 million otherwise required to be appropriated to 11 the fund from the general fund. Notwithstanding the standing 12 allocation from the REAP fund to the open spaces account, DNR 13 may use moneys in the account for state park maintenance and 14 repair. 15 CODE CHANGES. The bill makes several Code changes. 16 The bill provides a standing limited appropriation to 17 the renewable fuel infrastructure fund contingent upon the 18 enactment of legislation relating to motor fuel and biofuels, 19 including programs to support the installation, replacement, or 20 conversion of ethanol and biodiesel infrastructure. 21 The bill extends the final fiscal year for the annual 22 appropriation from the general fund of state for deposit to the 23 Iowa resources enhancement and protection fund from the fiscal 24 year ending June 30, 2023, to the fiscal year ending June 30, 25 2026. 26 -27- LSB 1001HV (1) 89 da/tm 27/ 27
