H.F. 846 Section 1. Section 321G.31, subsection 1, Code 2021, is 1 amended to read as follows: 2 1. If ownership of a snowmobile is transferred by 3 operation of law, such as by inheritance, order in bankruptcy, 4 insolvency, replevin, or execution sale, the transferee, within 5 thirty days after acquiring the right to possession of the 6 snowmobile, shall mail or deliver to the county recorder of 7 the transferee’s county of residence satisfactory proof of 8 ownership as the county recorder requires, together with an 9 application for a new certificate of title, and the required 10 fee. However, if the transferee is the surviving spouse of the 11 deceased owner, the county recorder shall waive the required 12 fee. 13 Sec. 2. Section 321I.33, subsection 1, Code 2021, is amended 14 to read as follows: 15 1. If ownership of an all-terrain vehicle is transferred by 16 operation of law, such as by inheritance, order in bankruptcy, 17 insolvency, replevin, or execution sale, the transferee, 18 within thirty days after acquiring the right to possession of 19 the all-terrain vehicle, shall mail or deliver to the county 20 recorder of the transferee’s county of residence satisfactory 21 proof of ownership as the county recorder requires, together 22 with an application for a new certificate of title, and the 23 required fee. However, if the transferee is the surviving 24 spouse of the deceased owner, the county recorder shall waive 25 the required fee. 26 Sec. 3. Section 462A.82, subsection 1, Code 2021, is amended 27 to read as follows: 28 1. If ownership of a vessel is transferred by operation of 29 law, such as by inheritance, order in bankruptcy, insolvency, 30 replevin, execution sale, or in compliance with section 578A.7 , 31 the transferee, within thirty days after acquiring the right 32 to possession of the vessel by operation of law, shall mail or 33 deliver to the county recorder satisfactory proof of ownership 34 as the county recorder requires, together with an application 35 -1- LSB 2770HZ (1) 89 th/ns 1/ 2
H.F. 846 for a new certificate of title, and the required fee. A title 1 tax is not required on these transactions. However, if the 2 transferee is the surviving spouse of the deceased owner, the 3 county recorder shall waive the required fee. 4 EXPLANATION 5 The inclusion of this explanation does not constitute agreement with 6 the explanation’s substance by the members of the general assembly. 7 Under current law, when ownership of a snowmobile, 8 all-terrain vehicle (ATV), or vessel is transferred by 9 operation of law, such as by inheritance, order in bankruptcy, 10 insolvency, replevin, or execution sale, the transferee 11 must pay a required certificate of title fee as part of the 12 application process to transfer ownership. The fee is paid to 13 the county recorder. 14 This bill requires that if the transferee is the surviving 15 spouse of the deceased owner, the county recorder must waive 16 the required fee. 17 The title fee for snowmobiles and ATVs is $10 and the title 18 fee for vessels is $5. 19 -2- LSB 2770HZ (1) 89 th/ns 2/ 2
