Definition.

For
purposes
of
this
chapter,
“search
warrant”
means
a
search

warrant
issued
pursuant
to
chapter
808.

Removal
of
devices.
10
On
or
before
July
1,
2021,
a
state
agency,
state
official,

or
state
employee
that
has
placed
a
photo,
video,
or
audio
12
recording
device
on
private
property
in
this
state
in
violation
13
of
section
27B.2
shall
cease
using
and
remove
the
photo,
video,
14
or
audio
recording
device.

Sec.
4.
EFFECTIVE
DATE.
This
Act,
being
deemed
of
immediate
16
importance,
takes
effect
upon
enactment.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
19
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
prohibits
a
state
agency,
state
official,
or
state
21
employee
from
placing
a
photo,
video,
or
audio
recording
device
22
on
private
property
in
Iowa
without
obtaining
either
a
search
23
warrant
or
express
permission
from
an
owner
of
the
property.

The
bill
requires
a
state
agency,
state
official,
or
state
25
employee
that
has
placed
a
photo,
video,
or
audio
recording
26
device
on
private
property
in
violation
of
the
bill
to
cease
27
using
and
remove
the
photo,
video,
or
audio
recording
device
on
28
or
before
July
1,
2021.
29
The
bill
takes
effect
upon
enactment.
