1.
NEW
SECTION
.
135.39E
Vaccinations
——
health
care
1
provider
requirements.
2
1.
For
the
purposes
of
this
section,
“health
care
provider”
3
means
any
licensed
health
care
professional,
organization,
or
4
institution,
whether
public
or
private,
including
federal,
5
state,
and
local
departments,
agencies,
and
instrumentalities,
6
under
whose
authority
a
licensed
or
emergency
use
vaccine
is
7
administered.

2.
A
health
care
provider
shall
comply
with
the
requirements
9
of
42
U.S.C.
§300aa-25
and
42
U.S.C.
§300aa-26,
including
that
10
the
health
care
provider
shall
document
any
adverse
event
11
following
the
vaccination
that
the
patient
experiences
within
12
eight
weeks
post-administration
and
that
becomes
known
to
13
the
health
care
provider,
submit
the
report
to
the
federal
14
food
and
drug
administration
vaccine
adverse
event
reporting
15
system,
and
provide
the
adult
patient,
or
the
parent
or
legal
16
representative
of
a
minor
patient,
with
a
copy
of
the
report.

statewide
immunization

registry
——
licensee
discipline.

1.
A
health
professional
required
to
be
licensed
under
21
this
chapter
who
is
authorized
to
administer
a
vaccination
22
or
immunization
shall
become
an
enrolled
user
and
report
the
23
administration
of
vaccines
and
immunizations
to
the
statewide
24
immunization
registry.
25
2.
For
the
purposes
of
this
section:
26
a.
“Enrolled
user
”
means
a
user
of
the
registry
who
has
27
completed
an
enrollment
form
that
specifies
the
conditions
28
under
which
the
registry
can
be
accessed
and
who
has
been
29
issued
an
identification
code
and
password
by
the
department.
30
b.
“Statewide
immunization
registry”
or
“registry”
means
31
the
database
and
file
server
maintained
by
the
department
as
32
well
as
the
software
application
that
allows
enrolled
users
to
33
exchange
immunization
or
health
screening
records.

3.
CODE
EDITOR
DIRECTIVE.
The
Code
editor
may
2
designate
section
147.163,
as
enacted
in
this
Act,
as
a
new
3
subchapter
within
chapter
147,
entitled
“REQUIRED
REPORTING
OF
4
ADMINISTRATION
OF
VACCINES
AND
IMMUNIZATIONS”.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
7
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
relates
to
the
requirements
for
health
care
9
providers
and
health
professionals
who
administer
vaccinations
10
and
immunizations.
11
The
bill
requires
all
health
care
providers
to
comply
with
12
the
federal
requirements
applicable
to
health
care
providers
13
who
administer
vaccines,
including
documenting
and
reporting
14
any
adverse
event
following
the
vaccination
that
the
patient
15
experiences
within
eight
weeks
post-administration
and
that
16
becomes
known
to
the
health
care
provider
to
the
federal
food
17
and
drug
administration
vaccine
adverse
event
reporting
system;
18
and
providing
to
an
adult
patient,
or
the
parent
or
legal
19
representative
of
a
minor
patient,
a
copy
of
the
report.
20
The
bill
also
requires
all
licensed
health
professionals
21
authorized
to
administer
vaccinations
or
immunizations
to
be
22
enrolled
users
of
the
statewide
immunization
registry
and
23
report
such
administration
to
the
statewide
immunization
24
registry.
A
health
professional
who
violates
this
provision
is
25
subject
to
licensee
discipline.
