H.F. 758 Section 1. Section 558.66, subsection 3, paragraph b, 1 unnumbered paragraph 1, Code 2021, is amended to read as 2 follows: 3 An affidavit of or on behalf of a surviving joint tenant or 4 a person who owns the remainder interest. The affidavit shall 5 include substantially the following: 6 Sec. 2. Section 558.66, subsection 3, paragraph c, 7 unnumbered paragraph 1, Code 2021, is amended to read as 8 follows: 9 An affidavit by or for a person, other than an individual, 10 following a merger, consolidation, name change, or change of 11 fiduciary. The affidavit shall include substantially the 12 following, as applicable: 13 EXPLANATION 14 The inclusion of this explanation does not constitute agreement with 15 the explanation’s substance by the members of the general assembly. 16 This bill modifies provisions related to certain affidavits 17 accepted by county recorders for updating county transfer books 18 and indexes when a conveyance of real estate has not occurred 19 by striking the word “substantially” to describe what the 20 affidavit must contain. 21 -1- LSB 2766HV (1) 89 ko/jh 1/ 1
