H.F. 737 Section 1. Section 153.38, Code 2021, is amended to read as 1 follows: 2 153.38 Dental assistants —— scope of practice. 3 1. A registered dental assistant may perform those services 4 of assistance to a licensed dentist as determined by the 5 board by rule. A registered dental assistant with additional 6 education and training, as provided by the board by rule, 7 may become certified to perform expanded functions or become 8 qualified to participate in dental radiography. 9 2. Level one expanded function procedures for dental 10 assistants shall include the placement of dental sealants on 11 teeth. A registered dental assistant who has successfully 12 completed expanded function training for the placement of 13 dental sealants on teeth through the university of Iowa college 14 of dentistry or a program certified by the commission on dental 15 accreditation or through another program or entity approved by 16 the board may place dental sealants on teeth. 17 3. Services performed by a registered dental assistant 18 shall be performed under supervision of a licensed dentist, 19 but this section shall not be construed to authorize a dental 20 assistant to practice dentistry or dental hygiene. 21 4. The board shall not adopt rules that delegate to a dental 22 assistant the administration of local anesthesia or the removal 23 of plaque, stain, calculus, or hard natural material except by 24 toothbrush, floss, or rubber cup coronal polish. 25 5. Every licensed dentist who utilizes the services of 26 a registered dental assistant for the purpose of assistance 27 in the practice of dentistry shall be responsible for acts 28 delegated to the registered dental assistant. 29 6. A dentist shall delegate to a registered dental assistant 30 only those acts which are authorized to be delegated to 31 registered dental assistants by the board. 32 EXPLANATION 33 The inclusion of this explanation does not constitute agreement with 34 the explanation’s substance by the members of the general assembly. 35 -1- LSB 2528HV (3) 89 pf/rh 1/ 2
H.F. 737 This bill relates to the scope of practice of dental 1 assistants. 2 Under current law, a registered dental assistant may 3 perform those services of assistance to a licensed dentist 4 as determined by the dental board by rule. A registered 5 dental assistant with additional education and training, as 6 provided by the board by rule, may become certified to perform 7 expanded functions or become qualified to participate in dental 8 radiography. 9 Current law also provides that a registered dental assistant 10 who has successfully completed expanded function training 11 through the university of Iowa college of dentistry or a 12 program certified by the commission on dental accreditation may 13 place sealants on teeth. 14 The dental board noticed rule ARC 5381C, reviewed by the 15 administrative rules review committee on February 5, 2021, 16 proposed amending 650 IAC 23.6 to provide that level two 17 expanded function procedures for dental assistants include the 18 placement of sealants. 19 The bill provides instead that level one expanded function 20 procedures for dental assistants shall include the placement of 21 dental sealants on teeth and that a registered dental assistant 22 who has successfully completed training for the placement 23 of dental sealants on teeth through a program certified by 24 the commission on dental accreditation or through another 25 program or entity approved by the dental board may place dental 26 sealants on teeth. 27 -2- LSB 2528HV (3) 89 pf/rh 2/ 2
