Ambulatory
surgical
centers
1
——
emergency
care
policies
and
procedures.

1.
An
ambulatory
surgical
center
shall
have
in
place
3
established
written
policies
and
procedures
to
provide
4
appropriate
care
to
the
center’s
patients
if
a
patient
requires
5
emergency
care.
The
policies
and
procedures
shall
provide
for
6
all
of
the
following:
7
a.
Readily
available
on-site
equipment
and
supplies
and
the
8
appropriately
trained
staff
necessary
to
administer
emergency
9
care
protocols.
10
b.
Arrangement
for
immediate
emergency
transport
of
a
11
patient
to
a
local
hospital
when
emergency
services
are
12
required
and
notification
of
the
person
identified
by
the
13
patient
as
an
emergency
contact.
14
c.
The
documentation
required
to
accompany
the
patient
to
15
the
hospital
to
be
submitted
by
the
ambulatory
surgical
center
16
to
the
receiving
hospital
at
the
time
a
patient
is
transferred
17
for
emergency
care.
Such
documentation
shall
include
a
copy
18
of
the
patient’s
medical
records
related
to
the
procedure
19
scheduled
or
performed
at
the
ambulatory
surgical
center,
20
including
observations
of
the
patient’s
signs
and
symptoms,
21
any
treatment
provided
to
the
patient,
the
results
of
any
22
tests
performed
that
are
available
at
the
time
of
transfer,
23
and
a
copy
of
the
informed
written
consent
for
the
patient’s
24
procedure
scheduled
or
performed
at
the
ambulatory
surgical
25
center.

2.
For
the
purposes
of
this
section,
“ambulatory
surgical
27
center”
means
a
distinct
facility
that
operates
exclusively
28
for
the
purpose
of
providing
surgical
services
to
patients
not
29
requiring
hospitalization
and
in
which
the
expected
duration
of
30
services
does
not
exceed
twenty-four
hours
following
admission.

“Ambulatory
surgical
center”
includes
a
facility
that
otherwise
32
meets
the
definition
of
an
ambulatory
surgical
center
whether
33
or
not
licensed,
certified,
or
accredited
as
an
ambulatory
34
surgical
center
and
which
may
or
may
not
operate
on
a
partially
35

cash-only
or
completely
cash-only
basis.
“Ambulatory
surgical
1
center”
does
not
include
individual
or
group
practice
offices
2
of
private
physicians
or
podiatrists
that
do
not
contain
a
3
distinct
area
used
for
outpatient
surgical
treatment
on
a
4
regular
basis
or
that
only
provide
surgery
routinely
provided
5
in
a
physician’s
or
podiatrist’s
office
using
local
anesthesia
6
or
conscious
sedation;
individual
or
group
practice
offices
7
of
private
dentists;
or
a
portion
of
a
licensed
hospital
8
designated
for
outpatient
surgical
treatment.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
11
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
relates
to
emergency
care
policies
and
procedures
13
for
ambulatory
surgical
centers.
The
bill
specifies
the
14
established
written
policies
and
procedures
to
provide
15
appropriate
care
to
an
ambulatory
surgical
center’s
patients
if
16
a
patient
requires
emergency
care.
The
policies
and
procedures
17
shall
provide
for
readily
available
on-site
equipment
and
18
supplies
and
the
appropriately
trained
staff
necessary
to
19
administer
emergency
care
protocols;
arrangement
for
immediate
20
emergency
transport
of
a
patient
to
a
local
hospital
when
21
emergency
services
are
required
and
notification
of
the
person
22
identified
as
the
emergency
contact
of
the
patient;
and
the
23
documentation
required
to
accompany
a
patient
to
the
hospital
24
to
be
submitted
by
the
ambulatory
surgical
center
to
the
25
receiving
hospital
at
the
time
the
patient
is
transferred
for
26
emergency
care.
The
bill
defines
“ambulatory
surgical
center”
27
for
the
purposes
of
the
bill.
