H.F. 725 Section 1. Section 207.21, subsection 1, Code 2021, is 1 amended to read as follows: 2 1. a. The division shall participate in the abandoned 3 mine reclamation program under Pub. L. No. 95-87, Tit. IV, 4 codified at 30 U.S.C. ch. 25, subch. IV. There is established 5 an abandoned mine reclamation fund under the control of the 6 division. 7 b. The division shall also provide for the reclamation or 8 drainage abatement of lead mines as provided in this section 9 which shall be supported by moneys appropriated by federal 10 sources, if available. 11 Sec. 2. Section 207.21, subsection 2, paragraph a, 12 subparagraph (1), Code 2021, is amended to read as follows: 13 (1) Lands which were mined for coal or lead or affected by 14 such mining, waste banks, coal or lead processing, or other 15 coal or lead mining processes, and abandoned or left in an 16 inadequate reclamation status prior to August 3, 1977, and for 17 which there is no continuing reclamation responsibility under 18 state or federal laws. 19 EXPLANATION 20 The inclusion of this explanation does not constitute agreement with 21 the explanation’s substance by the members of the general assembly. 22 This bill amends provisions in Code section 207.21, which 23 provides for an abandoned coal mine reclamation program 24 supported by an abandoned mine reclamation fund administered 25 by the division of soil conservation and water quality of 26 the department of agriculture and land stewardship.
