H.F. 691 Section 1. EARLY AND PERIODIC SCREENING, DIAGNOSIS, AND 1 TREATMENT BENEFIT SERVICES —— MEDICAID —— QUALIFICATIONS FOR 2 NONCERTIFIED STAFF. The department of human services shall 3 amend the Medicaid state plan SPA #14-0022 approved as of 4 March 10, 2015, and retroactively effective to December 1, 5 2014, relating to preventive services as defined in 42 C.F.R. 6 §440.130(c), consistent with the provisions of 42 U.S.C. 7 §1905(a)(4)(B) for early and periodic screening, diagnosis, 8 and treatment benefits, to provide that, beginning July 1, 9 2021, the types of nonlicensed practitioners providing such 10 services may include, in addition to noncertified staff 11 with a bachelor’s degree in education, psychology, social 12 work, occupational therapy, physical therapy, or speech 13 language pathology, those nonlicensed practitioners who hold a 14 registered behavior technician certification from a nationally 15 recognized accrediting body including but not limited to the 16 behavior analyst certification board. 17 EXPLANATION 18 The inclusion of this explanation does not constitute agreement with 19 the explanation’s substance by the members of the general assembly. 20 This bill requires the department of human services 21 to amend the Medicaid state plan approved March 10, 2015, 22 and retroactively effective to December 1, 2014, relating 23 to preventive services for early and periodic screening, 24 diagnosis, and treatment benefits, beginning July 1, 2021, to 25 provide that the types of nonlicensed practitioners providing 26 such services may include, in addition to noncertified staff 27 with a bachelor’s degree in education, psychology, social 28 work, occupational therapy, physical therapy, or speech 29 language pathology, those nonlicensed practitioners who hold a 30 registered behavior technician certification from a nationally 31 recognized accrediting body including but not limited to the 32 behavior analyst certification board. 33 -1- LSB 2247HV (2) 89 pf/rh 1/ 1
