Section
481A.123,
Code
2021,
is
amended
by
adding
1
the
following
new
subsection:

NEW
SUBSECTION
.
8.
For
a
public
hunting
area,
as
defined
in
3
subsection
4,
under
control
of
the
department
that
is
adjacent
4
to
private
property
on
which
the
general
public
does
not
have
5
permission
to
hunt,
the
commission
shall
determine
by
rule
the
6
size
of
a
buffer
along
the
border
with
the
private
property
7
within
which
a
person
shall
not
place
a
tree
stand.

The
inclusion
of
this
explanation
does
not
constitute
agreement
with

the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
relates
to
the
placement
of
tree
stands
on
a
public
12
hunting
area.
For
purposes
of
the
bill,
a
public
hunting
13
area
is
land
or
water
available
for
hunting
by
the
public
14
and
identified
as
a
public
hunting
area
by
the
city,
county,
15
state,
or
federal
government.
Under
the
bill,
if
a
public
16
hunting
area
under
the
control
of
the
department
of
natural
17
resources
is
adjacent
to
private
property
on
which
the
general
18
public
does
not
have
permission
to
hunt,
the
natural
resource
19
commission
shall
determine
by
rule
the
size
of
a
buffer
along
20
the
border
with
the
private
property
within
which
a
person
21
shall
not
place
a
tree
stand.
22
A
violation
of
the
bill
is
punishable
by
a
scheduled
fine
of
23
$35.
