H.F. 596 Section 1. REPEAL. Sections 650.6, 650.10, and 650.14, Code 1 2021, are repealed. 2 Sec. 2. APPLICABILITY. This Act applies to actions filed on 3 or after July 1, 2021. 4 EXPLANATION 5 The inclusion of this explanation does not constitute agreement with 6 the explanation’s substance by the members of the general assembly. 7 Code chapter 650 provides procedures for determining the 8 boundaries between adjoining tracts of land which cannot 9 otherwise be established (e.g., the monuments marking the 10 corners of the tract of land have been lost or destroyed). 11 Current law allows either party to such a dispute to plea 12 acquiescence, and if the court finds that the boundaries and 13 corners alleged to have been recognized and acquiesced in have 14 in fact been recognized and acquiesced in for a period of 10 15 years, such recognized boundaries and corners are permanently 16 established. 17 This bill repeals Code sections 650.6, 650.10, and 650.14, 18 which eliminates the doctrine of acquiescence in actions to 19 establish disputed boundaries or corners.
