H.F. 59 Section 1. Section 331.301, subsection 6, Code 2021, is 1 amended by adding the following new paragraph: 2 NEW PARAGRAPH . e. (1) A county shall not adopt or 3 enforce an ordinance, motion, resolution, or amendment that 4 bans a person from owning a specific breed of dog, including 5 through an ordinance, motion, resolution, or amendment based 6 on physical, behavioral, or genetic features that in effect 7 would ban a person from owning a specific breed of dog. For 8 purposes of this paragraph, “dog” means a domestic dog or the 9 offspring of a domestic dog and a wolf, or the offspring from 10 each subsequent generation in which at least one parent is a 11 domestic dog. 12 (2) An ordinance, motion, resolution, or amendment adopted 13 prior to the effective date of this Act that violates this 14 paragraph is void and unenforceable on and after the effective 15 date of this Act. 16 Sec. 2. Section 364.3, subsection 3, Code 2021, is amended 17 by adding the following new paragraph: 18 NEW PARAGRAPH . e. (1) A city shall not adopt or enforce an 19 ordinance, motion, resolution, or amendment that bans a person 20 from owning a specific breed of dog, including through an 21 ordinance, motion, resolution, or amendment based on physical, 22 behavioral, or genetic features that in effect would ban a 23 person from owning a specific breed of dog.
