H.F. 565 Section 1. Section 692.15, subsection 7, Code 2021, is 1 amended to read as follows: 2 7. The hate Hate crimes listed in under section 729A.2 are 3 subject to the reporting requirements of this section . 4 Sec. 2. Section 729A.2, Code 2021, is amended to read as 5 follows: 6 729A.2 Violation of individual rights —— hate crime. 7 “Hate crime” means one of the following any public offenses 8 offense when committed against a person or a person’s 9 property because of the person’s race, color, religion, 10 ancestry, national origin, political affiliation, sex, 11 sexual orientation, age, or disability, or the person’s 12 association with a person of a certain race, color, religion, 13 ancestry, national origin, political affiliation, sex, sexual 14 orientation, age, or disability : . A hate crime shall be 15 classified and punished as an offense one degree higher than 16 the underlying offense. 17 1. Assault in violation of individual rights under section 18 708.2C . 19 2. Violations of individual rights under section 712.9 . 20 3. Criminal mischief in violation of individual rights 21 under section 716.6A . 22 4. Trespass in violation of individual rights under section 23 716.8, subsections 3 and 4 . 24 Sec. 3. REPEAL. Sections 712.9 and 716.6A, Code 2021, are 25 repealed. 26 EXPLANATION 27 The inclusion of this explanation does not constitute agreement with 28 the explanation’s substance by the members of the general assembly. 29 This bill relates to hate crimes and provides penalties. 30 Current law provides that “hate crime” means one of the 31 following public offenses when committed against a person 32 or a person’s property because of the person’s race, color, 33 religion, ancestry, national origin, political affiliation, 34 sex, sexual orientation, age, or disability, or the person’s 35 -1- LSB 1926YH (5) 89 as/rh 1/ 2
H.F. 565 association with a person of a certain race, color, religion, 1 ancestry, national origin, political affiliation, sex, sexual 2 orientation, age, or disability: assault in violation of 3 individual rights under Code section 708.2C; violations of 4 individual rights under Code section 712.9; criminal mischief 5 in violation of individual rights under Code section 716.6A; 6 and trespass in violation of individual rights under Code 7 section 716.8(3)(4). 8 The bill provides that “hate crime” means any public offense 9 when committed against a person or a person’s property because 10 of the person’s race, color, religion, ancestry, national 11 origin, political affiliation, sex, sexual orientation, age, 12 or disability, or the person’s association with a person of 13 a certain race, color, religion, ancestry, national origin, 14 political affiliation, sex, sexual orientation, age, or 15 disability.
