H.F. 532 Section 1. QUALIFIED INSTRUCTION FUNDING SUPPLEMENT FOR FY 1 2020-2021 —— APPROPRIATION. 2 1. a. For the school budget year beginning July 1, 3 2020, and ending June 30, 2021, each public school district 4 shall receive a qualified instruction funding supplement. 5 The supplement shall be in an amount calculated by the 6 department of management equal to the percentage of the amount 7 appropriated under subsection 4 that is proportionate to the 8 school district’s total in-person instruction days as a share 9 of the statewide total in-person instruction days. 10 b. For purposes of this section: 11 (1) “Total in-person instruction days” means the sum of the 12 number of school days the school district offered in-person 13 instruction within the school district between August 23, 2020, 14 and January 29, 2021, multiplied by the actual enrollment of 15 the school district for the budget year beginning July 1, 2020. 16 Each school day for which the school district offered in-person 17 instruction to all students within the school district for six 18 or more hours shall be counted as one school day. Each school 19 day for which the school district offered in-person instruction 20 to all students within the school district for three or more 21 hours but less than six hours shall be counted as one-half of 22 a school day. Each school day for which the school district 23 offered in-person instruction to one-half or more but less than 24 all students for six or more hours shall be counted as one-half 25 of a school day. 26 (2) “Statewide total in-person instruction days” means the 27 sum of each amount determined under subparagraph (1) for all 28 public school districts in the state. 29 2. The qualified instruction funding supplement shall be 30 miscellaneous income, shall be deposited in the general fund of 31 the school district, may be used for any school general fund 32 purpose, and shall not be included in district cost. 33 3. The qualified instruction funding supplement shall be 34 paid at the same time and in the same manner as foundation 35 -1- LSB 2434HZ (1) 89 md/jh 1/ 3
H.F. 532 aid is paid under section 257.16, and may be included in the 1 remaining monthly payments of state aid under section 257.16, 2 subsection 2, for the budget year beginning July 1, 2020. 3 4. There is appropriated from the general fund of the state 4 to the department of management for the fiscal year beginning 5 July 1, 2020, and ending June 30, 2021, thirty million dollars 6 to be used for the payment of qualified instruction funding 7 supplement payments under this section. 8 5. Each public school district in the state shall certify to 9 the department of management on or before the fourteenth day 10 after the effective date of this Act, the school district’s 11 total in-person instruction days as determined under subsection 12 1, paragraph “b”, subparagraph (1). 13 Sec. 2. EFFECTIVE DATE. This Act, being deemed of immediate 14 importance, takes effect upon enactment. 15 EXPLANATION 16 The inclusion of this explanation does not constitute agreement with 17 the explanation’s substance by the members of the general assembly. 18 This bill establishes a qualified instruction funding 19 supplement for the school budget year beginning July 1, 2020. 20 Each public school district shall receive a qualified 21 instruction funding supplement in an amount calculated by the 22 department of management equal to the percentage of the $30 23 million appropriated in the bill that is proportionate to the 24 school district’s total in-person instruction days as a share 25 of the statewide total in-person instruction days. Under the 26 bill, “total in-person instruction days” means the sum of the 27 number of school days the school district offered in-person 28 instruction within the school district between August 23, 2020, 29 and January 29, 2021, multiplied by the actual enrollment of 30 the school district for the budget year beginning July 1, 2020. 31 Each school day for which the school district offered in-person 32 instruction to all students within the school district for six 33 or more hours shall be counted as one school day. Each school day for which the school district 3 offered in-person instruction to one-half or more but less than 4 all students for six or more hours shall be counted as one-half 5 of a school day. “Statewide total in-person instruction 6 days” means the sum of each school district’s total in-person 7 instruction days for all public school districts in the state. 8 The qualified instruction funding supplement is 9 miscellaneous income, shall be deposited in the general fund of 10 the school district, may be used for any school general fund 11 purpose, and shall not be included in district cost. 12 The bill appropriates from the general fund of the state to 13 the department of management $30 million for the purpose of 14 making all qualified instruction funding supplement payments 15 under the bill. 16 The bill requires each public school district in the state 17 to certify to the department of management on or before the 18 14th day after the effective date of the bill, the school 19 district’s total in-person instruction days as determined under 20 the provisions of the bill. 21 The bill takes effect upon enactment. 22 -3- LSB 2434HZ (1) 89 md/jh 3/ 3
