H.F. 510 Section 1. Section 901C.3, subsection 2, paragraph e, Code 1 2021, is amended to read as follows: 2 e. A conviction under section 321J.2 , except for a 3 conviction under section 321J.2, subsection 2, paragraph “a” , 4 involving a defendant who was twenty-five years of age or 5 younger at the time of the offense, and if the offense did not 6 involve a serious injury, as defined in section 702.18, to any 7 person other than to the defendant . 8 EXPLANATION 9 The inclusion of this explanation does not constitute agreement with 10 the explanation’s substance by the members of the general assembly. 11 This bill relates to the expungement of an 12 operating-while-intoxicated (OWI) offense that is a serious 13 misdemeanor under certain circumstances. 14 Current law does not allow the expungement of a conviction 15 under Code section 321J.2. The bill provides that a conviction 16 under Code section 321J.2 that is a serious misdemeanor shall 17 not be expunged except for a conviction involving a defendant 18 who was 25 years of age or younger at the time of the offense, 19 and the offense did not involve a serious injury, as defined in 20 Code section 702.18, to any person other than to the defendant. 21 -1- LSB 2491YH (3) 89 as/rh 1/ 1
