H.F. 427 Section 1. Section 80E.1, subsection 2, paragraphs a and b, 1 Code 2021, are amended to read as follows: 2 a. Direct the governor’s office of drug control policy, 3 and coordinate and monitor all statewide narcotics drug 4 enforcement efforts, coordinate and monitor all state and 5 federal substance abuse use disorder treatment grants and 6 programs, coordinate and monitor all statewide substance abuse 7 prevention and education programs in communities and schools, 8 and engage in such other related activities as required by 9 law. The coordinator shall work in coordinating the efforts 10 of the department of corrections, the department of education, 11 the Iowa department of public health, the department of public 12 safety, and the department of human services. The coordinator 13 shall assist in the development and implementation of local and 14 community strategies to fight substance abuse, including local 15 law enforcement, education, and treatment activities. 16 b. Submit an annual report to the governor and general 17 assembly by November 1 of each year concerning the activities 18 and programs of the coordinator and other departments related 19 to drug enforcement, substance abuse use disorder treatment 20 programs, and substance abuse prevention and education 21 programs. The report shall include an assessment of needs with 22 respect to programs related to substance abuse use disorder 23 treatment and narcotics drug enforcement. 24 Sec. 2. Section 80E.2, subsections 1 and 2, Code 2021, are 25 amended to read as follows: 26 1. An Iowa drug policy advisory council is established which 27 shall consist of the following fifteen seventeen members: 28 a. The drug policy coordinator, who shall serve as 29 chairperson of the council. 30 b. The director of the department of corrections, or the 31 director’s designee. 32 c. The director of the department of education, or the 33 director’s designee. 34 d. The director of the Iowa department of public health, or 35 -1- LSB 1317HV (4) 89 as/rh 1/ 3
H.F. 427 the director’s designee. 1 e. The commissioner of public safety, or the commissioner’s 2 designee. 3 f. The director of the department of human services, or the 4 director’s designee. 5 g. The director of the division of criminal and juvenile 6 justice planning in the department of human rights, or the 7 division director’s designee. 8 h. The state public defender, or the state public defender’s 9 designee. 10 h. i. A prosecuting attorney. 11 i. j. A licensed substance abuse treatment specialist 12 certified alcohol and drug counselor . 13 j. k. A certified substance abuse prevention specialist. 14 k. l. A substance abuse use disorder treatment program 15 director. 16 l. m. A justice of the Iowa supreme court, or judge, as 17 designated by the chief justice of the supreme court. 18 m. n. A member representing the Iowa peace officers 19 association. 20 n. o. A member representing the Iowa state police 21 association. 22 o. p. A member representing the Iowa state sheriffs’ and 23 deputies’ association. 24 q. A police chief. 25 2. The prosecuting attorney, licensed substance abuse 26 treatment specialist certified alcohol and drug counselor , 27 certified substance abuse prevention specialist, substance 28 abuse use disorder treatment program director, member 29 representing the Iowa peace officers association, member 30 representing the Iowa state police association, and the 31 member representing the Iowa state sheriffs’ and deputies’ 32 association , and the member representing the Iowa police chiefs 33 association shall be appointed by the governor, subject to 34 senate confirmation, for four-year terms beginning and ending 35 -2- LSB 1317HV (4) 89 as/rh 2/ 3
H.F. 427 as provided in section 69.19 . A vacancy on the council shall 1 be filled for the unexpired term in the same manner as the 2 original appointment was made. 3 EXPLANATION 4 The inclusion of this explanation does not constitute agreement with 5 the explanation’s substance by the members of the general assembly. 6 This bill relates to the Iowa drug policy coordinator and the 7 Iowa drug policy advisory council. 8 The bill makes changes to the terminology used in describing 9 the duties of the Iowa drug policy coordinator. “Narcotics 10 enforcement” is changed to “drug enforcement”, and “substance 11 abuse” is changed to “substance use disorder” when referring to 12 treatment programs and professionals. 13 The bill increases the number of members of the Iowa drug 14 policy advisory council from 15 to 17. The additional members, 15 to be appointed by the governor, are the state public defender 16 or the state public defender’s designee and a police chief. 17 The names of certain current members on the advisory council 18 were changed to more accurately describe the stakeholders. 19 -3- LSB 1317HV (4) 89 as/rh 3/ 3
