H.F. 408 Section 1. Section 724.9, subsection 1, paragraphs a and b, 1 Code 2021, are amended to read as follows: 2 a. Completion of any national rifle association a handgun 3 safety training course offered by an instructor certified by 4 an organization approved by the department of public safety 5 pursuant to section 724.9A . 6 b. Completion of any handgun safety training course 7 available to the general public offered by a law enforcement 8 agency, community college, college, private or public 9 institution or organization, or firearms training school, 10 utilizing instructors certified by the national rifle 11 association or an organization approved by the department of 12 public safety pursuant to section 724.9A or another state’s 13 department of public safety, state police department, or 14 similar certifying body. 15 Sec. 2. NEW SECTION . 724.9A Approval of organizations that 16 may certify handgun safety training instructors. 17 1. The department of public safety shall adopt rules to 18 approve organizations that may certify individuals as handgun 19 safety training instructors eligible to offer a handgun safety 20 training course under section 724.9, subsection 1, paragraphs 21 “a” and “b” . The rules shall require a handgun safety training 22 instructor to apply to the organization for recertification at 23 least once every five years and shall require the organization 24 to pay a fee to cover costs necessary to maintain a list of 25 approved organizations and certified instructors. 26 2. The department shall maintain on the department’s 27 internet site the following resources: 28 a. Applications for an organization to receive approval to 29 certify and recertify handgun safety training instructors. 30 b. A list of organizations approved under this section 31 that certify handgun safety training instructors and a list of 32 certified instructors. The department shall use an interface 33 that allows a user to sort the lists in a manner that provides 34 convenience to the user, such as but not limited to sorting 35 -1- LSB 1232YH (5) 89 js/rh 1/ 2

H.F. 408 by geographic location or online instruction as opposed to 1 in-person, hands-on instruction. 2 c. General information relating to permits to carry weapons, 3 firearm safety, and training opportunities currently available 4 to the public. 5 EXPLANATION 6 The inclusion of this explanation does not constitute agreement with 7 the explanation’s substance by the members of the general assembly. 8 This bill relates to the approval of organizations that may 9 certify individuals to offer a handgun safety training course. 10 Current law requires an applicant for an initial permit to 11 carry weapons to demonstrate knowledge of firearm safety. An 12 applicant may demonstrate knowledge of firearm safety by, 13 among other methods, completing any national rifle association 14 handgun safety training course or completing any handgun safety 15 training course available to the general public offered by 16 certain entities that utilize an instructor certified by the 17 national rifle association. 18 The bill requires the department of public safety 19 (department) to adopt rules to approve organizations that 20 may certify an individual as an instructor eligible to offer 21 certain handgun safety training courses. The rules shall 22 require a handgun safety training instructor to apply to the 23 organization for recertification at least once every five 24 years. The rules shall also require the department to charge a 25 fee to cover the costs necessary to maintain a list of approved 26 organizations and a list of certified instructors. 27 The bill requires the department to maintain on the 28 department’s internet site applications for an organization 29 to receive approval to certify and recertify handgun safety 30 training instructors, a list of approved organizations 31 that certify handgun safety training instructors, a list 32 of certified instructors, and general information relating 33 to permits to carry weapons, firearm safety, and training 34 opportunities currently available to the public. 35 -2- LSB 1232YH (5) 89 js/rh 2/ 2
