H.F. 390 Section 1. NEW SECTION . 135.39E Fluoridation in public 1 water supply —— notice of discontinuance. 2 1. At least ninety days prior to taking any action to 3 discontinue fluoridation in its water supply, an owner or 4 operator of a public water supply system, as defined in section 5 455B.171, shall provide notice to the oral and health delivery 6 system bureau established in section 135.15 and the public 7 water supply system’s customers. 8 2. In order to provide notice to its customers, the owner or 9 operator of the public water supply system shall place a notice 10 on each customer’s water bill or provide notice in a way that 11 is reasonably calculated so that all customers will receive the 12 notice. 13 EXPLANATION 14 The inclusion of this explanation does not constitute agreement with 15 the explanation’s substance by the members of the general assembly. 16 This bill relates to requirements for providing notice 17 prior to discontinuing fluoridation in a public water supply 18 system. For purposes of the bill, a public water supply system 19 provides to the public piped water for human consumption and 20 has at least 15 service connections or regularly serves at 21 least 25 individuals. A public water supply system includes 22 any source of water and any collection, treatment, storage, and 23 distribution facilities under control of the operator of the 24 system and used primarily in connection with the system, and 25 any collection or pretreatment storage facilities not under 26 such control that are used primarily in connection with the 27 system. 28 The bill requires the owner or operator of a public water 29 supply system to provide notice to the oral and health delivery 30 system bureau in the department of public health and the public 31 water supply system’s customers at least 90 days prior to 32 taking any action to discontinue fluoridation in the system’s 33 water supply. The owner or operator of the system shall 34 provide notice to its customers by placing a notice on each 35 -1- LSB 1858HV (3) 89 js/ns 1/ 2
H.F. 390 customer’s water bill or by providing notice in a way that is 1 reasonably calculated so that all customers will receive the 2 notice. 3 By operation of law, a person who knowingly violates the 4 provisions of the bill is guilty of a simple misdemeanor.
