H.F. 387 Section 1. Section 321.194, subsection 2, paragraph a, 1 unnumbered paragraph 1, Code 2021, is amended to read as 2 follows: 3 The driver’s license entitles the licensee, while having the 4 license in immediate possession, to operate a motor vehicle, 5 other than a commercial motor vehicle , a motor vehicle with 6 more than two axles, a motor vehicle towing another vehicle, or 7 as a chauffeur, during the times and for the purposes set forth 8 in this paragraph. 9 Sec. 2. Section 321.194, subsection 2, paragraph a, Code 10 2021, is amended by adding the following new subparagraph: 11 NEW SUBPARAGRAPH . (03) If the licensee resides on a farm 12 or is employed for compensation on a farm in this state, 13 the licensee may operate a motor vehicle during the hours 14 of 5:00 a.m. to 10:00 p.m. for the purpose of assisting the 15 person’s parents, guardians, or employers with farm work or in 16 connection with any farm job, employment, or other farm-related 17 work, including traveling to or from the location of the farm 18 work, provided the licensee operates the vehicle over the most 19 direct and accessible route between the point of origin and 20 the destination and the driving distance between the point of 21 origin and the destination is no more than fifty miles. 22 Sec. 3. Section 321.194, subsection 2, paragraph a, 23 subparagraph (3), Code 2021, is amended to read as follows: 24 (3) To a service station for the purpose of refueling, so 25 long as the service station is the station closest to the route 26 on which the licensee is traveling under subparagraph (1) , or 27 (2) , or (03) . 28 Sec. 4. Section 321.194, subsection 3, paragraph b, Code 29 2021, is amended to read as follows: 30 b. Upon receipt of a statement of necessity, the department 31 shall issue the driver’s license provided the applicant is 32 otherwise eligible for issuance of the license. The fact that 33 the applicant resides at a distance less than one mile from the 34 applicant’s school of enrollment is prima facie evidence of 35 -1- LSB 1339HV (3) 89 th/ns 1/ 3
H.F. 387 the nonexistence of necessity for the issuance of a license. 1 However, the distance between the applicant’s residence and 2 school of enrollment shall not be considered if the applicant 3 resides on a farm or is employed for compensation on a farm. 4 EXPLANATION 5 The inclusion of this explanation does not constitute agreement with 6 the explanation’s substance by the members of the general assembly. 7 Under current law, a person holding a special minor’s 8 driver’s license is allowed to operate a motor vehicle, other 9 than a commercial motor vehicle or as a chauffeur, during 10 the hours of 5:00 a.m. to 10:00 p.m. between the licensee’s 11 residence, schools of enrollment, bus stops, and sites, 12 facilities, or schools designated by the licensee’s district 13 or school of enrollment for the accommodation of the school’s 14 extracurricular activities, with certain limitations. This 15 bill prohibits a person holding a special minor’s driver’s 16 license from operating a motor vehicle with more than two axles 17 and a motor vehicle towing another vehicle. 18 The bill allows a person holding a special minor’s driver’s 19 license who resides on a farm or is employed for compensation 20 on a farm in this state to operate a motor vehicle during the 21 hours of 5:00 a.m. to 10:00 p.m. for the purpose of assisting 22 the person’s parents, guardians, or employers with farm work 23 or in connection with any farm job, employment, or other 24 farm-related work, including traveling to or from the location 25 of the farm work, provided the person operates the vehicle 26 over the most direct and accessible route between the point of 27 origin and the destination and the driving distance between the 28 point of origin and the destination is no more than 50 miles. 29 The bill also allows a licensee to operate a motor vehicle to a 30 service station along the associated routes. 31 Under current law, an application for a special minor’s 32 driver’s license must be accompanied by a statement from 33 the applicant’s school of enrollment certifying that a need 34 exists for the license. H.F. 387 at a distance less than one mile from the applicant’s school 1 of enrollment is prima facie evidence of the nonexistence of 2 necessity for the issuance of the license. However, the bill 3 provides that the distance between the applicant’s residence 4 and school of enrollment shall not be considered regarding the 5 existence of a necessity if the applicant resides on a farm or 6 is employed for compensation on a farm. 7 A violation of Code section 321.194 is punishable by a 8 scheduled fine of $70. 9 -3- LSB 1339HV (3) 89 th/ns 3/ 3
