Section
1.
Section
216.18,
Code
2021,
is
amended
by
adding
1
the
following
new
subsection:

This
chapter
shall
not
be
construed
such

a
right
afforded
to
a
person
under
this
chapter
based
on

the
person’s
gender
identity
interferes
with
a
right
afforded
5
under
this
chapter
based
on
a
person’s
sex,
particularly
if
the

person
claiming
a
right
based
on
sex
is
a
woman.
“Woman”
for
7
purposes
of
this
subsection
means
a
person
born
with
female
8
genitalia
and
reproductive
organs.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
11
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
provides
that,
if
in
conflict,
rights
provided
13
on
the
basis
of
sex
under
the
Iowa
civil
rights
Act
of
1965
14
have
priority
over
the
rights
afforded
to
a
person
under
the
15
Iowa
civil
rights
Act
of
1965
based
on
the
person’s
gender
16
identity,
particularly
if
the
right
provided
on
the
basis
of
17
sex
is
claimed
by
a
woman.
The
bill
defines
“woman”
as
a
person
18
born
with
female
genitalia
and
reproductive
organs.
Current
19
law
defines
“gender
identity”
as
the
gender-related
identity
of
20
a
person,
regardless
of
the
person’s
assigned
sex
at
birth.
