1.
NEW
SECTION
.
314.32
Road
salt
use
reduction
1
programs.
2
1.
As
used
in
this
section,
unless
the
context
otherwise
3
requires:
4
a.
“Road
salt”
means
sodium
chloride,
calcium
chloride,
5
magnesium
chloride,
or
any
other
substance
containing
chloride
6
used
to
treat
or
control
the
accumulation
of
ice
and
snow
on
7
highways
and
streets.
8
b.
“Winter
season”
means
November
1
through
May
31.
9
2.
Each
agency
shall
create
a
road
salt
use
reduction
10
program
within
its
jurisdiction.
Under
the
program,
the
agency
11
shall
reduce
the
amount
of
road
salt
used
on
the
highways
and
12
streets
under
its
jurisdiction
and
control
at
a
rate
of
five
13
percent
per
winter
season
for
five
winter
seasons
beginning
14
with
the
winter
season
commencing
on
November
1,
2021.
The
15
required
five
percent
reduction
in
road
salt
use
shall
be
16
measured
against
the
amount
of
road
salt
used
by
the
agency
17
during
the
preceding
winter
season,
except
that
the
reduction
18
required
for
the
first
winter
season
of
the
program
shall
be
19
measured
against
the
amount
of
road
salt
used
by
the
agency
in
20
the
winter
season
commencing
on
November
1,
2019.

3.
Each
agency
shall
proportionally
increase
its
use
of
22
organic
additives,
including
the
byproducts
of
midwestern-grown
23
renewable
crops,
to
treat
or
control
the
accumulation
of
ice
24
and
snow
on
highways
and
streets
such
that
no
decrease
in
the
25
effectiveness
of
snow
and
ice
treatment
or
control
occurs.

4.
If
an
agency
fails
to
meet
the
required
five
percent
27
reduction
in
road
salt
used
in
any
winter
season,
that
agency
28
shall
add
the
amount
of
the
shortfall
to
the
following
winter
29
season’s
required
reduction,
increasing
the
percentage
target
30
accordingly.

a.
A
county,
city,
or
other
municipality
subject
to
the
32
program
requirements
set
forth
in
this
section
shall
certify
33
and
file
a
report
with
the
department
on
or
before
June
30

following
each
winter
season
in
which
it
is
required
to
reduce

The
department
shall
also

a
report
on

The
reports
required
by
this
paragraph
shall

all
of
the
following:

(1)
The
amount
of
road
salt
used
by
the
agency
during
the
6
most
recent
winter
season.

(2)
The
amount
of
road
salt
used
by
the
agency
during
the
8
winter
season
preceding
the
most
recent
winter
season,
except
9
that
the
report
required
following
the
first
winter
season
of
10
the
program
shall
include
the
amount
of
road
salt
used
by
the
11
agency
during
the
winter
season
commencing
on
November
1,
2019.

The
percentage
difference
between
the
amount
reported
13
pursuant
to
subparagraph
(1)
and
the
amount
reported
pursuant
14
to
subparagraph
(2).

b.
On
or
before
July
31
following
each
winter
season
16
in
which
an
agency
is
required
to
create
a
report
pursuant
17
to
paragraph
“a”
,
the
department
shall
compile
its
report
18
and
the
reports
received
from
counties,
cities,
and
other
19
municipalities
pursuant
to
paragraph
“a”
into
a
cumulative
20
report
and
submit
the
cumulative
report
in
electronic
format
21
to
the
chairpersons
of
the
senate
and
house
of
representatives
22
standing
committees
on
transportation
and
the
legislative
23
services
agency.

Sec.
2.
IMPLEMENTATION
OF
ACT.
Section
25B.2,
subsection
25
3,
shall
not
apply
to
this
Act.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
28
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
requires
each
agency,
meaning
a
governmental
body
30
which
exercises
jurisdiction
over
any
road
as
provided
by
law,
31
including
the
department
of
transportation
(DOT),
to
create
32
a
road
salt
use
reduction
program.
Under
the
program,
each
33
agency
must
reduce
the
amount
of
road
salt
used
on
the
highways
34
and
streets
under
its
jurisdiction
and
control
at
a
rate
of
5

percent
per
winter
season
for
five
winter
seasons
beginning
1
with
the
winter
season
commencing
on
November
1,
2021.
The

2
percent
reduction
is
measured
against
the
amount
of
road
salt
3
used
by
the
agency
during
the
preceding
winter
season,
except
4
that
the
reduction
required
for
the
winter
season
commencing
on
5
November
1,
2021,
is
measured
against
the
amount
of
road
salt
6
used
in
the
winter
season
commencing
on
November
1,
2019.
The
7
bill
defines
the
terms
“road
salt”
and
“winter
season”.
8
The
bill
requires
each
agency
to
proportionally
increase
9
its
use
of
organic
additives,
including
the
byproducts
of
10
midwestern-grown
renewable

to
treat
or

the

of

and

the
winter
season
preceding
the
most
recent
winter
season,

except
the
report
required
following
the
first
winter
season
28
of
the
program
shall
include
the
amount
of
road
salt
used
by
29
the
agency
during
the
winter
season
commencing
in
2019;
and
the
30
percentage
difference
between
the
two
amounts.
On
or
before
31
July
31
following
each
winter
season,
the
DOT
must
then
compile
32
its
report
and
the
reports
received
from
counties,
cities,
and

other
municipalities
into
a
cumulative
report
and

the

The
bill
may
include
a
state
mandate
as
defined
in
Code
3
section
25B.3.
The
bill
makes
inapplicable
Code
section
25B.2,
4
subsection
3,
which
would
relieve
a
political
subdivision
from
5
complying
with
a
state
mandate
if
funding
for
the
cost
of
6
the
state
mandate
is
not
provided
or
specified.
Therefore,
7
political
subdivisions
are
required
to
comply
with
any
state
8
mandate
included
in
the
bill.
