Section
1.
SHORT
TITLE.
This
Act
shall
be
known
as
1
“Adalynn’s
Law”.
2
Sec.
2.
NEW
SECTION
.
216C.13
Adult
changing
stations.
3
1.
For
purposes
of
this
section,
“adult
changing
station”
4
means
a
universally
accessible,
height-adjustable
adult
5
changing
table
placed
within
an
enclosed
restroom
facility
6
or
other
similar
facility
that
is
for
use
by
persons
with
7
disabilities
who
need
assistance
with
diapering.
8
2.
An
adult
changing
station
shall
be
installed
and
9
maintained
at
all
of
the
following
locations:
10
a.
Any
new
building
or
facility
to
which
the
public
is
11
invited
or
in
which
the
public
is
permitted.
12
b.
Any
renovated
building
or
facility
to
which
the
public
13
is
invited
or
in
which
the
public
is
permitted,
where
such
14
renovations
require
a
permit,
certificate,
authorization,
or
15
other
required
document
or
where
the
renovations
will
cost
ten
16
thousand
dollars
or
more.

c.
Any
building
or
facility
to
which
the
public
is
invited
18
or
in
which
the
public
is
permitted,
with
the
capacity
to
serve
19
one
thousand
five
hundred
or
more
persons
in
any
one
day,
20
including
but
not
limited
to
state
buildings
and
facilities.

d.
Shopping
malls
and
retail
stores
with
a
floor
space
of
22
forty
thousand
square
feet
or
more.
23
e.
Entertainment
venues
with
a
floor
space
of
forty
thousand
24
square
feet
or
more,
including
but
not
limited
to
theaters,
25
concert
halls,
auditoriums,
and
other
facilities
primarily
used
26
for
exhibiting
motion
pictures,
stage
performances,
lectures,
27
musical
recitals,
and
other
similar
performances,
bingo

facilities,
gambling
structures,
and
indoor
arenas
including
29
sports
arenas.

f.
Public
transportation
facilities
under
the
authority
31
of
the
state
or
its
political
subdivisions,
including
bus

stations.

g.
Galleries,
libraries,
museums,
and
tourist
information

centers.

Each
location
required
to
install
and
maintain
an
adult
9
changing
station,
as
provided
for
in
subsection
2,
shall
10
ensure
that
the
entrance
to
each
adult
changing
station
has
11
conspicuous
signage
indicating
the
location
of
the
adult
12
changing
station.
13
4.
A
person
who
violates
this
section
shall
be
assessed
a
14
civil
penalty
by
the
department
of
human
rights
which
is
not
15
to
exceed
two
hundred
fifty
dollars.
Moneys
collected
under
16
this
subsection
shall
be
remitted
to
the
treasurer
of
state
for
17
deposit
in
the
general
fund
of
the
state.

Sec.
3.
IMPLEMENTATION
OF
ACT.
Section
25B.2,
subsection
19
3,
shall
not
apply
to
this
Act.

Sec.
4.
EFFECTIVE
DATE.
This
Act
takes
effect
January
1,
21
2022.

Sec.
5.
APPLICABILITY.
23
1.
Section
216C.13,
subsection
2,
paragraph
“a”,
as
enacted
24
in
this
Act,
applies
to
buildings
and
facilities
on
which
25
construction
will
commence
on
or
after
January
1,
2023.

2.
Section
216C.13,
subsection
2,
paragraph
“b”,
as
enacted
27
in
this
Act,
applies
to
buildings
and
facilities
on
which
28
renovations
will
commence
on
or
after
January
1,
2026.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
31
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
requires
the
installation
and
maintenance
of
adult
33
changing
stations
at
certain
locations.
The
bill
defines
the
34
term
“adult
changing
station”.

be
installed
and
maintained
in
certain
new

buildings
and
facilities
constructed
on
or
after
January
1,
2
2023;
certain
buildings
or
facilities
renovated
on
or
after
3
January
1,
2026;
buildings
or
facilities
with
the
capacity
4
to
serve
1,500
or
more
persons
in
any
one
day;
shopping
5
malls,
retail
stores,
and
certain
entertainment
venues
with
6
a
floor
space
of
40,000
square
feet
or
more;
certain
public
7
transportation
facilities;
galleries,
libraries,
museums,
and
8
tourist
information
centers;
parks,
playgrounds,
recreational
9
centers,
zoos,
and
amusement
or
theme
parks;
certain
airports;
10
rest
areas;
education
facilities;
hospitals;
and
rehabilitation
11
facilities.
Each
location
required
to
install
an
adult
12
changing
station
is
required
to
install
conspicuous
signage
13
at
the
entrance
of
each
adult
changing
station
indicating
its
14
location.
15
A
violation
of
the
bill
is
punishable
by
a
civil
penalty
16
not
to
exceed
$250
to
be
assessed
by
the
department
of
human
17
rights.
Moneys
collected
are
to
be
remitted
to
the
treasurer
18
of
state
for
deposit
in
the
general
fund.
19
The
bill
may
include
a
state
mandate
as
defined
in
Code
20
section
25B.3.
The
bill
makes
inapplicable
Code
section
25B.2,
21
subsection
3,
which
would
relieve
a
political
subdivision
from
22
complying
with
a
state
mandate
if
funding
for
the
cost
of
23
the
state
mandate
is
not
provided
or
specified.
Therefore,
24
political
subdivisions
are
required
to
comply
with
any
state
25
mandate
included
in
the
bill.
26
The
bill
takes
effect
January
1,
2022.
27
The
bill
shall
be
known
as
“Adalynn’s
Law”.
