H.F. 266 Section 1. BUDGET ENROLLMENTS, WEIGHTED ENROLLMENTS, AND 1 ENROLLMENTS SERVED FOR SCHOOL BUDGET YEAR 2021-2022. 2 1. For the budget year beginning July 1, 2021, if a school 3 district’s budget enrollment otherwise determined under section 4 257.6, subsection 4, is less than the school district’s budget 5 enrollment for the budget year beginning July 1, 2020, the 6 department of management shall, notwithstanding any provision 7 of law to the contrary, adjust the school district’s budget 8 enrollment for the budget year beginning July 1, 2021, to equal 9 the budget enrollment for the budget year beginning July 1, 10 2020. The adjusted budget enrollment figure shall be used to 11 calculate all necessary funding amounts for the school budget 12 year beginning July 1, 2021. 13 2. For the budget year beginning July 1, 2021, if a school 14 district’s additional enrollment because of special education 15 otherwise determined under section 257.6, subsections 3 and 16 5, is less than the school district’s additional enrollment 17 because of special education for the budget year beginning July 18 1, 2020, the department of management shall, notwithstanding 19 any provision of law to the contrary, adjust the school 20 district’s additional enrollment because of special education 21 for the budget year beginning July 1, 2021, to equal the 22 additional enrollment because of special education for the 23 budget year beginning July 1, 2020. The adjusted additional 24 enrollment because of special education figure shall be used to 25 calculate all necessary funding amounts for the school budget 26 year beginning July 1, 2021. 27 3. For the budget year beginning July 1, 2021, if a school 28 district’s additional pupils added due to the application 29 of the supplementary weighting otherwise determined under 30 section 257.6, subsection 5, is less than the school district’s 31 additional pupils added due to the application of the 32 supplementary weighting for the budget year beginning July 33 1, 2020, the department of management shall, notwithstanding 34 any provision of law to the contrary, adjust the school 35 -1- LSB 1697YH (1) 89 md/jh 1/ 3

H.F. 266 district’s additional pupils added due to the application of 1 the supplementary weighting for the budget year beginning 2 July 1, 2021, to equal the additional pupils added due to the 3 application of the supplementary weighting for the budget 4 year beginning July 1, 2020. The adjusted additional pupils 5 added due to the application of the supplementary weighting 6 figure shall be used to calculate all necessary funding 7 amounts for the school budget year beginning July 1, 2021, 8 and the proportions of supplementary weighting attributable 9 to each supplementary weighting category shall be equal to 10 the proportion of such weighting for the school budget year 11 beginning July 1, 2020. 12 4. For the budget year beginning July 1, 2021, if a 13 school district’s preschool budget enrollment otherwise 14 determined under section 256C.5 is less than the school 15 district’s preschool budget enrollment for the budget year 16 beginning July 1, 2020, the department of management shall, 17 notwithstanding any provision of law to the contrary, adjust 18 the school district’s preschool budget enrollment for the 19 budget year beginning July 1, 2021, to equal the preschool 20 budget enrollment for the budget year beginning July 1, 2020. 21 The adjusted preschool budget enrollment figure shall be used 22 to calculate all necessary preschool funding amounts for the 23 school budget year beginning July 1, 2021. 24 5. For the budget year beginning July 1, 2021, if an area 25 education agency’s enrollment served otherwise determined under 26 section 257.37, subsection 4, is less than the area education 27 agency’s enrollment served for the budget year beginning July 28 1, 2020, the department of management shall, notwithstanding 29 any provision of law to the contrary, adjust the area education 30 agency’s enrollment served for the budget year beginning July 31 1, 2021, to equal the enrollment served for the budget year 32 beginning July 1, 2020. The adjusted enrollment served figure 33 shall be used to calculate all necessary funding amounts for 34 the school budget year beginning July 1, 2021. 35 -2- LSB 1697YH (1) 89 md/jh 2/ 3

H.F. 266 Sec. 2. EFFECTIVE DATE. This Act, being deemed of immediate 1 importance, takes effect upon enactment. 2 EXPLANATION 3 The inclusion of this explanation does not constitute agreement with 4 the explanation’s substance by the members of the general assembly. 5 For purposes of calculating school district funding under 6 Code chapter 257, a school district’s budget enrollment for a 7 budget year is the basic enrollment for that budget year, which 8 is equal to the school district’s actual enrollment (headcount) 9 for the base year (preceding budget year). This bill provides 10 that for the budget year beginning July 1, 2021, if a school 11 district’s budget enrollment is less than the school district’s 12 budget enrollment for the budget year beginning July 1, 2020, 13 the department of management, notwithstanding any provision 14 of law to the contrary, is required to adjust the district’s 15 budget enrollment to equal the budget enrollment for the budget 16 year beginning July 1, 2020. Similarly, for the budget year 17 beginning July 1, 2021, if a school district’s additional 18 enrollment because of special education, weighted enrollment 19 added due to supplementary weighting, or preschool budget 20 enrollment is less than the applicable corresponding amount 21 for the budget year beginning July 1, 2020, the department of 22 management is required to adjust the district’s additional 23 enrollment because of special education, weighted enrollment 24 added due to supplementary weighting, or preschool budget 25 enrollment, as applicable, to equal the corresponding amount 26 for the budget year beginning July 1, 2020. The bill also 27 establishes a similar provision for the determination of an 28 area education agency’s “enrollment served” under Code section 29 257.37. 30 The bill takes effect upon enactment. 31 -3- LSB 1697YH (1) 89 md/jh 3/ 3
