H.F. 265 Section 1. Section 298A.8, subsection 1, Code 2021, is 1 amended to read as follows: 2 1. The student activity fund is a special revenue fund. 3 A student activity fund must be established in any school 4 corporation receiving money from student-related activities 5 such as admissions, activity fees, student dues, student 6 fund-raising events, or other student-related cocurricular or 7 extracurricular activities. Moneys in this fund shall be used 8 to support only the cocurricular or extracurricular program 9 defined in department of education administrative rules. 10 Sec. 2. Section 298A.8, Code 2021, is amended by adding the 11 following new subsection: 12 NEW SUBSECTION . 3. For the school budget year beginning 13 July 1, 2021, and the school budget year beginning July 1, 14 2022, the board of directors may, by board resolution and 15 notwithstanding any provision of law to the contrary, transfer 16 from the school corporation’s general fund or any other fund 17 of the school corporation to the student activity fund an 18 amount necessary, as recommended by the superintendent, to fund 19 cocurricular or extracurricular activities for which moneys 20 from student-related activities such as admissions, activity 21 fees, student dues, student fund-raising events, or other 22 student-related cocurricular or extracurricular activities fail 23 to meet the financial needs of the activity. This subsection 24 is replealed July 1, 2023. 25 EXPLANATION 26 The inclusion of this explanation does not constitute agreement with 27 the explanation’s substance by the members of the general assembly. 28 This bill provides that for the school budget year beginning 29 July 1, 2021, and the school budget year beginning July 1, 30 2022, the school board may, by resolution, transfer from 31 the school corporation’s general fund or any other fund 32 of the school corporation to the student activity fund an 33 amount necessary, as recommended by the superintendent, to 34 fund cocurricular or extracurricular activities for which 35 -1- LSB 2213HH (3) 89 md/jh 1/ 2
H.F. 265 moneys from admissions, activity fees, student dues, student 1 fund-raising events, or other student-related cocurricular or 2 extracurricular activities fail to meet the financial needs of 3 the activity.
