In supporting projects in watersheds and subwatersheds 2 as provided in paragraph “b”, all of the following shall apply: 3 (1) The demonstration projects shall utilize water quality 4 practices as described in the latest revision of the document 5 entitled “Iowa Nutrient Reduction Strategy” initially presented 6 in November 2012 by the department of agriculture and land 7 stewardship, the department of natural resources, and Iowa 8 state university of science and technology. 9 (2) The division shall implement demonstration projects as 10 provided in subparagraph (1) by providing for participation by 11 persons who hold a legal interest in agricultural land used in 12 farming. To every extent practical, the division shall provide 13 for collaborative participation by such persons who hold a 14 legal interest in agricultural land located within the same 15 subwatershed. 16 (3) The division shall implement demonstration projects on 17 a cost-share basis as determined by the division. Except for 18 edge-of-field practices, the state’s share of the amount shall 19 not exceed 50 percent of the estimated cost of establishing the 20 practice as determined by the division or 50 percent of the 21 actual cost of establishing the practice, whichever is less. 22 (4) The demonstration projects shall be used to educate 23 other persons about the feasibility and value of establishing 24 similar water quality practices. The division shall promote 25 field day events for purposes of allowing interested persons to 26 establish water quality practices on their agricultural land. 27 (5) The division shall conduct water quality evaluations 28 within supported subwatersheds. Within a reasonable period 29 after accumulating information from such evaluations, the 30 division shall create an aggregated database of water quality 31 practices. Any information identifying a person holding a 32 legal interest in agricultural land or specific agricultural 33 land shall be a confidential record. 34 d. The moneys appropriated in this subsection shall be used 35 -2- LSB 5008HV (1) 89 ec/tm 2/ 18

H.F. 2579 to support education and outreach in a manner that encourages 1 persons who hold a legal interest in agricultural land used for 2 farming to implement water quality practices, including the 3 establishment of such practices in watersheds generally, and 4 not limited to subwatersheds or high-priority watersheds. 5 e. The moneys appropriated in this subsection may be used 6 to contract with persons to coordinate the implementation of 7 efforts provided in this subsection. 8 f. The moneys appropriated in this subsection may be used 9 by the department to support urban soil and water conservation 10 efforts, which may include but are not limited to management 11 practices related to bioretention, landscaping, the use of 12 permeable or pervious pavement, and soil quality restoration. 13 The moneys shall be allocated on a cost-share basis as provided 14 in chapter 161A . 15 g. Notwithstanding any other provision of law to the 16 contrary, the department may use moneys appropriated in this 17 subsection to carry out the provisions of this subsection on a 18 cost-share basis in combination with other moneys available to 19 the department from a state or federal source. 20 h. Not more than 10 percent of the moneys appropriated in 21 this subsection may be used for costs of administration and 22 implementation of the water quality initiative administered by 23 the soil conservation division. 24 3. Section 8.57C, subsection 3, paragraph a, 1 subparagraph (3), Code 2022, is amended to read as follows: 2 (3) For the fiscal year beginning July 1, 2022 2023 , and for 3 each subsequent fiscal year thereafter, the sum of seventeen 4 million five hundred thousand dollars. 5 Sec. 14. Section 8.57C, subsection 3, Code 2022, is amended 6 by adding the following new paragraph: 7 NEW PARAGRAPH . j. There is appropriated from the rebuild 8 Iowa infrastructure fund for the fiscal year beginning July 1, 9 2022, and ending June 30, 2023, the sum of twenty million five 10 hundred thousand dollars to the technology reinvestment fund, 11 notwithstanding section 8.57, subsection 5, paragraph “c” . 12 Sec. 15. Section 602.11101, subsection 1, paragraph e, 13 subparagraph (2), Code 2022, is amended to read as follows: 14 (2) Until July 1, 1986, the county shall remain responsible 15 for the compensation of and operating costs for court 16 employees not presently designated for state financing and 17 for miscellaneous costs of the judicial branch related to 18 furnishings, supplies, and equipment purchased, leased, or 19 maintained for the use of judicial officers, referees, and 20 their staff. Effective July 1, 1986, the state shall assume 21 the responsibility for the compensation of and operating costs 22 for court employees presently designated for state financing 23 and for miscellaneous costs of the judicial branch related to 24 furnishings, supplies, and equipment purchased, leased, or 25 maintained for the use of judicial officers, referees, and 26 their staff. However, the county shall at all times remain 27 responsible for the provision of suitable courtrooms, offices, 28 and other physical facilities pursuant to section 602.1303, 29 subsection 1 , including paint, wall covering, and fixtures in 30 the facilities. In addition, however, effective July 1, 2023, 31 if a county expends moneys for the renovation or construction 32 of suitable courtrooms, offices, and other physical facilities 33 pursuant to section 602.1303, that requires the purchase of 34 furnishings, supplies, and equipment for the use of judicial 35 -14- LSB 5008HV (1) 89 ec/tm 14/ 18

H.F. 2579 officers, referees, and their staff as a result of that 1 renovation or construction, the state shall be responsible for 2 only fifty percent of the cost of the purchase. 3 DIVISION V 4 SPORTS TOURISM PROGRAM 5 Sec. 16. Section 15F.401, subsections 4, 5, and 6, Code 6 2022, are amended to read as follows: 7 4. An applicant shall demonstrate matching funds in order 8 to receive financial assistance pursuant to this section . The 9 amount of matching funds that may be required shall be at the 10 board’s discretion. An applicant under the program shall not 11 receive financial assistance from the sports tourism program 12 fund created in section 15F.403 in an amount exceeding fifty 13 twenty-five percent of the total cost of the project. 14 5. The board shall make final funding decisions on 15 each application and may approve, deny, defer, or modify 16 applications for financial assistance under the program, in 17 its discretion, in order to fund as many projects with the 18 moneys available as possible. The board and the authority may 19 negotiate with applicants regarding the details of projects 20 and the amount and terms of any award. The total amount of 21 financial assistance provided to an applicant in any one 22 fiscal year shall not exceed five hundred thousand ten million 23 dollars. In making final funding decisions pursuant to this 24 subsection , the board and the authority are exempt from chapter 25 17A . 26 6. a. A city, county, or public entity may use financial 27 assistance received under the program for marketing and 28 promotions. Whether an activity or individual cost item is 29 directly related to the promotion of the sporting event shall 30 be within the discretion of the authority infrastructure . 31 b. All applications to the authority for financial 32 assistance shall be made at least ninety days prior to an 33 event’s scheduled date. A city, county, or public entity shall 34 not use financial assistance received under the program as 35 -15- LSB 5008HV (1) 89 ec/tm 15/ 18

H.F. 2579 reimbursement for completed projects. 1 EXPLANATION 2 The inclusion of this explanation does not constitute agreement with 3 the explanation’s substance by the members of the general assembly. 4 This bill relates to and makes appropriations to state 5 departments and agencies from the rebuild Iowa infrastructure 6 fund and the technology reinvestment fund, and provides for 7 related matters. The bill is organized by divisions. 8 DIVISION I —— REBUILD IOWA INFRASTRUCTURE FUND. This 9 division appropriates project funding for FY 2022-2023 from 10 the rebuild Iowa infrastructure fund for projects for the 11 departments of administrative services, agriculture and land 12 stewardship, the blind, corrections, cultural affairs, human 13 services, natural resources, public defense, public safety, and 14 transportation, and for the economic development authority, 15 board of regents, state fair authority, treasurer of state, and 16 the judicial branch. 17 DIVISION II —— TECHNOLOGY REINVESTMENT FUND. This 18 division appropriates project funding for FY 2022-2023 19 from the technology reinvestment fund for the departments 20 of corrections, education, homeland security and emergency 21 management, human rights, human services, inspections and 22 appeals, management, public defense, public safety, and 23 revenue, and for the Iowa telecommunications and technology 24 commission, and the judicial branch. 25 DIVISION III —— CHANGES TO PRIOR APPROPRIATIONS. This 26 division allows moneys appropriated from the technology 27 reinvestment fund to the department of human services over 28 multiple fiscal years beginning with FY 2018-2019 that would 29 revert if unencumbered and unexpended three years after the 30 close of the fiscal year in which the appropriation was made 31 to not revert until four years after the close of the fiscal 32 year in which the appropriation was made. The division also 33 allows moneys appropriated to the Iowa veterans home for FY 34 2019-2020 that would revert if unencumbered and unexpended 35 -16- LSB 5008HV (1) 89 ec/tm 16/ 18

H.F. 2579 as of June 30, 2022, to not revert but remain available for 1 expenditure until the close of the fiscal year beginning July 2 1, 2022. The division also allows moneys appropriated to the 3 department of human services for FY 2019-2020 that would revert 4 if unencumbered and unexpended as of June 30, 2022, to not 5 revert but remain available for expenditure until the close of 6 the fiscal year beginning July 1, 2023. 7 The division also makes a change to moneys appropriated 8 from the rebuild Iowa infrastructure fund to the department 9 of public defense for a readiness center in West Des Moines, 10 the department of homeland security for emergency services 11 programs, and to the board of regents for projects at the Iowa 12 state university of science and technology and the university 13 of northern Iowa. 14 This division of the bill takes effect upon enactment. 15 DIVISION IV —— MISCELLANEOUS PROVISIONS. Code section 16 8.57C, concerning the technology reinvestment fund, is amended 17 to provide that the standing appropriation to the fund from 18 the general fund for fiscal years beginning on or after July 19 1, 2022, is changed to fiscal years beginning on or after July 20 1, 2023, and to provide for an appropriation to the technology 21 reinvestment fund from the rebuild Iowa infrastructure fund for 22 the fiscal year beginning July 1, 2022, of $20.5 million. 23 Code section 602.11101, concerning responsibility for county 24 courthouses and attendant costs, is amended to provide that, 25 effective July 1, 2023, for a county that expends moneys for 26 the renovation or construction of suitable courtrooms, offices, 27 and other physical facilities that requires the purchase of 28 furnishings, supplies, and equipment as a result of that 29 renovation or construction, the state shall be responsible for 30 only 50 percent of the cost of the purchase. 31 DIVISION V —— SPORTS TOURISM PROGRAM. This division amends 32 Code section 15F.401, concerning the sports tourism program. 33 The bill limits financial assistance to an applicant under 34 the program to no more than 25 percent of the total cost of 35 -17- LSB 5008HV (1) 89 ec/tm 17/ 18
