H.F. 2544 Section 1. Section 135D.4, Code 2022, is amended to read as 1 follows: 2 135D.4 Iowa health information network —— principles —— 3 technical infrastructure requirements —— required participants . 4 1. The Iowa health information network shall be 5 administered and governed by a designated entity using, at a 6 minimum, the following principles: 7 a. Be patient-centered and market-driven. 8 b. Comply with established national standards. 9 c. Protect the privacy of consumers and the security and 10 confidentiality of all health information. 11 d. Promote interoperability. 12 e. Increase the accuracy, completeness, and uniformity of 13 data. 14 f. Preserve the choice of the patient to have the patient’s 15 health information available through the record locator 16 service. 17 g. Provide education to the general public and provider 18 communities on the value and benefits of health information 19 technology. 20 2. Widespread adoption of health information technology is 21 critical to a successful Iowa health information network and is 22 best achieved when all of the following occur: 23 a. The network, through the designated entity complying 24 with chapter 504 and reporting as required under this chapter , 25 operates in an entrepreneurial and businesslike manner in which 26 it is accountable to all participants utilizing the network’s 27 products and services. 28 b. The network provides a variety of services from which to 29 choose in order to best fit the needs of the user. 30 c. The network is financed by all who benefit from the 31 improved quality, efficiency, savings, and other benefits that 32 result from use of health information technology. 33 d. H.F. 2544 3. The Iowa health information network technical 1 infrastructure shall provide a mechanism for all of the 2 following: 3 a. The facilitation and support of the secure electronic 4 exchange of health information between participants. 5 b. Participants without an electronic health records system 6 to access health information from the Iowa health information 7 network. 8 4. Nothing in this chapter shall be interpreted to 9 impede or preclude the formation and operation of regional, 10 population-specific, or local health information networks 11 or the participation of such networks in the Iowa health 12 information network. 13 5. All hospitals and payors in the state shall contract with 14 the designated entity and shall comply with all requirements as 15 participants under this chapter. The cost of and consideration 16 for any such contract or future amendment to such contract 17 shall be mutually agreed upon, in writing, by all parties to 18 the contract. Automatic pricing term changes shall not be 19 included in any such contract. 20 EXPLANATION 21 The inclusion of this explanation does not constitute agreement with 22 the explanation’s substance by the members of the general assembly. 23 This bill requires all hospitals and payors in the state to 24 contract with the designated entity (the nonprofit corporation 25 designated by the department of public health to be responsible 26 for administering and governing the Iowa health information 27 network) and to comply with all requirements as participants 28 under Code chapter 135D (Iowa health information network). 29 The bill also provides that the cost of and consideration for 30 any such contract or future amendment to such contract shall 31 be mutually agreed upon, in writing, by all parties and that 32 automatic pricing term changes shall not be included in any 33 such contract. 34 -2- LSB 6179HV (3) 89 pf/rh 2/ 2
