H.F. 2513 Section 1. Section 8A.416, Code 2022, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 8. For purposes of this section: 3 a. “Protective hairstyle” means the same as defined in 4 section 216.2. 5 b. “Race” means the same as defined in section 216.2. 6 Sec. 2. Section 15A.1, subsection 1, paragraph b, Code 2022, 7 is amended to read as follows: 8 b. For purposes of this chapter , “economic development” : 9 (1) “Economic development” means private or joint public 10 and private investment involving the creation of new jobs and 11 income or the retention of existing jobs and income that would 12 otherwise be lost. 13 (2) “Protective hairstyle” means the same as defined in 14 section 216.2. 15 (3) “Race” means the same as defined in section 216.2. 16 Sec. 3. Section 19B.1, Code 2022, is amended by adding the 17 following new subsections: 18 NEW SUBSECTION . 1A. “Protective hairstyle” means the same 19 as defined in section 216.2. 20 NEW SUBSECTION . 1B. “Race” means the same as defined in 21 section 216.2. 22 Sec. 4. Section 216.2, Code 2022, is amended by adding the 23 following new subsections: 24 NEW SUBSECTION . 12A. “Protective hairstyle” includes 25 braids, locs, twists, tight coils or curls, cornrows, bantu 26 knots, afros, and headwraps. 27 NEW SUBSECTION . 13A. “Race” is a grouping of humans based 28 upon physical traits commonly or historically associated with a 29 group including but not limited to skin color, hair texture, 30 hair type, or a protective hairstyle. 31 Sec. 5. Section 256.2, Code 2022, is amended by adding the 32 following new subsections: 33 NEW SUBSECTION . 3A. “Protective hairstyle” means the same 34 as defined in section 216.2. 35 -1- LSB 5652YH (5) 89 cm/jh 1/ 4

Section 256B.2, subsection 1, Code 2022, is amended 3 by adding the following new paragraphs: 4 NEW PARAGRAPH . 0b. “Protective hairstyle” means the same as 5 defined in section 216.2. 6 NEW PARAGRAPH . 00b. “Race” means the same as defined in 7 section 216.2. 8 Sec. 7. Section 256F.2, Code 2022, is amended by adding the 9 following new subsections: 10 NEW SUBSECTION . 6A. “Protective hairstyle” means the same 11 as defined in section 216.2. 12 NEW SUBSECTION . 6B. “Race” means the same as defined in 13 section 216.2. 14 Sec. 8. Section 261A.4, Code 2022, is amended by adding the 15 following new subsections: 16 NEW SUBSECTION . 17. “Protective hairstyle” means the same 17 as defined in section 216.2. 18 NEW SUBSECTION . 18. “Race” means the same as defined in 19 section 216.2. 20 Sec. 9. Section 279.58, Code 2022, is amended by adding the 21 following new subsection: 22 NEW SUBSECTION . 3. a. The board of directors of a school 23 district shall not adopt, for the district or for an individual 24 school within the district, a dress code policy that prohibits 25 students from wearing protective hairstyles that are commonly 26 or historically associated with a race. 27 b. For purposes of this subsection: 28 (1) “Protective hairstyle” means the same as defined in 29 section 216.2. 30 (2) “Race” means the same as defined in section 216.2. 31 Sec. 10. Section 280.2, Code 2022, is amended by adding the 32 following new subsections: 33 NEW SUBSECTION . 1A. “Protective hairstyle” means the same 34 as defined in section 216.2. 35 -2- LSB 5652YH (5) 89 cm/jh 2/ 4

Section 341A.1, Code 2022, is amended by adding the 3 following new subsections: 4 NEW SUBSECTION . 4. “Protective hairstyle” means the same as 5 defined in section 216.2. 6 NEW SUBSECTION . 5. “Race” means the same as defined in 7 section 216.2. 8 Sec. 12. Section 400.17, Code 2022, is amended by adding the 9 following new subsection: 10 NEW SUBSECTION . 5. For the purposes of this section: 11 a. “Protective hairstyle” means the same as defined in 12 section 216.2. 13 b. “Race” means the same as defined in section 216.2. 14 Sec. 13. Section 602.1401, Code 2022, is amended by adding 15 the following new subsection: 16 NEW SUBSECTION . 7. For the purposes of this section: 17 a. “Protective hairstyle” means the same as defined in 18 section 216.2. 19 b. “Race” means the same as defined in section 216.2. 20 Sec. 14. Section 729.4, Code 2022, is amended by adding the 21 following new subsection: 22 NEW SUBSECTION . 4. For the purposes of this section: 23 a. “Protective hairstyle” means the same as defined in 24 section 216.2. 25 b. “Race” means the same as defined in section 216.2. 26 EXPLANATION 27 The inclusion of this explanation does not constitute agreement with 28 the explanation’s substance by the members of the general assembly. 29 This bill provides an additional prohibition against 30 discrimination in schools, workplaces, housing, places of 31 public accommodations, and other contexts on the basis of 32 hair texture, hair type, and protective hairstyles that are 33 historically and commonly associated with race. 34 The following current Code sections prohibit discrimination 35 -3- LSB 5652YH (5) 89 cm/jh 3/ 4
H.F. 2513 based on race: Code section 8A.416 (state employment), Code 1 section 15A.1 (state disbursement of grant funds), Code section 2 19B.1 (state employment and contracts), Code chapter 216 (civil 3 rights commission), Code chapter 256 (department of education), 4 Code chapter 256B (area education agencies), Code chapter 5 256F (charter schools and innovation zone schools), Code 6 chapter 261A (higher education loan authority), Code section 7 279.58 (school directors), Code chapter 280 (uniform school 8 requirements), Code section 341A.1 (civil service for deputy 9 county sheriffs), Code section 400.17 (employees under civil 10 service), Code section 602.1401 (judicial personnel), and Code 11 section 729.4 (fair employment practices). 12 The bill provides that discrimination on the basis of race 13 includes discrimination on the basis of protective hair styles. 14 The bill defines “protective hairstyles” as including braids, 15 locs, twists, tight coils or curls, cornrows, bantu knots, 16 afros, and headwraps. 17 -4- LSB 5652YH (5) 89 cm/jh 4/ 4
