H.F. 2494 Section 1. Section 249K.2, subsection 4, Code 2022, is 1 amended to read as follows: 2 4. “Major renovations” means construction or facility 3 improvements to a nursing facility in which the total amount 4 expended exceeds one million five seven hundred fifty thousand 5 dollars. 6 Sec. 2. Section 249K.5, subsection 2, Code 2022, is amended 7 by adding the following new paragraph: 8 NEW PARAGRAPH . c. The nursing facility for which relief 9 or an exception is requested is proposing replacement or 10 enhancement of an HVAC, as defined in section 105.2, system for 11 improved infection control. 12 Sec. 3. ADMINISTRATIVE RULES —— ADOPTION AND AMENDMENT. The 13 department of human services shall adopt or amend rules 14 pursuant to chapter 17A to administer this Act. 15 EXPLANATION 16 The inclusion of this explanation does not constitute agreement with 17 the explanation’s substance by the members of the general assembly. 18 This bill relates to nursing facility construction 19 or expansion under Code chapter 249K (nursing facility 20 construction or expansion). The Code chapter provides a 21 mechanism to support the appropriate number of nursing facility 22 beds for the state’s citizens and to financially assist nursing 23 facilities in remaining compliant with applicable regulations. 24 The bill provides that in order to be eligible for rate 25 relief and exceptions under the Code chapter, a nursing 26 facility’s major renovation value threshold is reduced from 27 $1.5 million to $750,000. The bill also provides that in 28 addition to the existing criteria, one of which a nursing 29 facility requesting instant relief or a nondirect care limit 30 exception must meet, an additional criterion is that the 31 nursing facility requesting relief or an exception is proposing 32 replacement or enhancement of an HVAC system for improved 33 infection control. For the purposes of the bill, “HVAC” means 34 heating, ventilation, air conditioning, ducted systems, or any 35 -1- LSB 6215HV (1) 89 pf/rh 1/ 2
