the

the
board
of
supervisors
has

not
established
or
has
dissolved
the
county
compensation
board,

the
board
of
supervisors
shall
carry
out
the
duties
of
the
4
county
compensation
board,
including
as
provided
in
section
5
331.907.

6.
Section
331.907,
subsections
1,
2,
and
3,
Code
2022,
7
are
amended
to
read
as
follows:

The
If
the
county
board
of
supervisors
has
established
9
a
county
compensation
board
pursuant
to
section
331.905,
the
10
annual
compensation
of
the
auditor,
treasurer,
recorder,
11
sheriff,
county
attorney,
and
supervisors
shall
be
determined
12
as
provided
in
this
section
.
The
county
compensation
board
13
annually
shall
review
the
compensation
paid
to
comparable
14
officers
in
other
counties
of
this
state,
other
states,
15
private
enterprise,
and
the
federal
government.
In
setting
the
16
salary
of
the
county
sheriff,
the
county
compensation
board
17
shall
set
the
sheriff’s
salary
so
that
it
is
comparable
to
18
salaries
paid
to
professional
law
enforcement
administrators
19
and
command
officers
of
the
state
patrol,
the
division
of
20
criminal
investigation
of
the
department
of
public
safety,
and
21
city
police
chiefs
employed
by
cities
of
similar
population
22
to
the
population
of
the
county.
The
county
compensation
23
board
shall
prepare
a
compensation
schedule
for
the
elective
24
elected
county
officers
for
the
succeeding
fiscal
year.
A
25
recommended
compensation
schedule
requires
a
majority
vote
of
26
the
membership
of
the
county
compensation
board.

2.
At
the
public
hearing
held
on
the
county
budget
as
28
provided
in
section
331.434
,
the
county
compensation
board
29
shall
submit
its
recommended
compensation
schedule
for
the
30
next
fiscal
year
to
the
board
of
supervisors
for
inclusion
31
in
the
county
budget.
The
board
of
supervisors
shall
review
32
the
recommended
compensation
schedule
for
the
elected
county
33
officers
and
determine
the
final
compensation
schedule
which
34
shall
not
exceed
the
compensation
schedule
recommended
by
35

the
county
compensation
board.
In
determining
the
final
1
compensation
schedule
if
the
board
of
supervisors
wishes
to
2
reduce
the
amount
of
the
recommended
compensation
schedule,
3
the
amount
of
salary
increase
proposed
for
each
elected
4
county
officer,
except
as
provided
in
subsection
3
,
shall
be
5
reduced
an
equal
percentage
.
A
copy
of
the
final
compensation
6
schedule
shall
be
filed
with
the
county
budget
at
the
office
7
of
the
director
of
the
department
of
management.
The
final
8
compensation
schedule
takes
effect
on
July
1
following
its
9
adoption
by
the
board
of
supervisors.

The
board
of
supervisors
may
adopt
a
decrease
in
11
compensation
paid
to
supervisors
irrespective
of
the
county
12
compensation
board’s
recommended
compensation
schedule
or
other
13
approved
changes
in
compensation
paid
to
other
elected
county
14
officers.
A
decrease
in
compensation
paid
to
supervisors
shall
15
be
adopted
by
the
board
of
supervisors
no
less
than
thirty
days
16
before
the
county
budget
is
certified
under
section
24.17
.

EXPLANATION
18
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
19
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
relates
to
methods
of
determining
compensation
for
21
elected
county
officers.
22
Under
current
law,
each
county
has
a
county
compensation
23
board
that
prepares
a
recommended
compensation
schedule
24
for
elected
county
officers
that
the
county
board
of
25
supervisors
then
reviews.
Current
law
provides
procedures
26
and
limitations
that
both
the
county
compensation
board
and
27
board
of
supervisors
must
adhere
to
in
determining
the
final
28
compensation
schedule.
29
The
bill
allows
a
board
of
supervisors
to
vote
to
establish
30
a
county
compensation
board.
The
county
compensation
board
31
shall
be
composed
as
provided
under
current
law.
The
board
of
32
supervisors
may
also
vote
to
dissolve
a
county
compensation
33
board.
The
board
of
supervisors
is
responsible
for
preparing
34
a
compensation
schedule
if
the
board
of
supervisors
has
not
35

established
or
has
dissolved
a
county
compensation
board.
The
1
bill
strikes
provisions
that
prohibit
the
board
of
supervisors
2
from
exceeding
the
compensation
schedule
recommended
by
the
3
county
compensation
board
or
from
reducing
the
amount
of
the
4
recommended
compensation
schedule
unless
the
amount
of
salary
5
increase
proposed
for
each
elected
county
officer
is
reduced
6
by
an
equal
percentage.
Further,
the
bill
strikes
a
provision
7
that
authorizes
the
board
of
supervisors
to
adopt
a
decrease
8
in
compensation
paid
to
supervisors
irrespective
of
the
9
compensation
board’s
recommended
compensation
schedule
or
other
10
approved
changes
in
compensation
paid
to
other
elected
county
11
officers.
The
bill
makes
conforming
changes.
