The general assembly may nullify the enforcement in this 3 state of a federal executive order or a decision of federal 4 court by a constitutional majority vote of each house of the 5 general assembly. A nullification pursuant to this subsection 6 is not subject to signature by the governor. 7 2. A federal executive order or a decision of a federal 8 court nullified by the general assembly pursuant to subsection 9 1 shall be unenforceable in this state and this state and the 10 citizens of this state shall not recognize or be obligated to 11 abide by the federal executive order or decision of a federal 12 court. 13 EXPLANATION 14 The inclusion of this explanation does not constitute agreement with 15 the explanation’s substance by the members of the general assembly. 16 This bill relates to the nullification of federal executive 17 orders and the decisions of federal courts. The bill allows 18 the general assembly to nullify a federal executive order or a 19 decision of a federal court by a constitutional majority vote 20 of each house of the general assembly. A nullification is not 21 subject to signature by the governor.
