Section
1.
Section
85.27,
subsection
1,
Code
2022,
is
1
amended
to
read
as
follows:

1.
a.
The
employer,
for
all
injuries
compensable
under
3
this
chapter
or
chapter
85A
,
shall
furnish
reasonable
surgical,
4
medical,
dental,
osteopathic,
chiropractic,
podiatric,
physical
5
rehabilitation,
nursing,
ambulance,
and
hospital
services
6
and
supplies
therefor
and
shall
allow
reasonably
necessary
7
transportation
expenses
incurred
for
such
services.
The
8
employer
shall
also
furnish
reasonable
and
necessary
crutches,
9
artificial
members
,
and
appliances
.
but
10
b.
An
employer
shall
not
be
required
to
furnish
more
than
11
one
set
of
permanent
prosthetic
devices.
12
c.
Paragraph
“b”
shall
not
apply
if
a
permanent
prosthetic
13
device
is
a
replacement
of
a
permanent
prosthetic
device
that
14
is
medically
necessary
as
a
result
of
a
compensable
injury
that
15
occurred
while
the
employee
was
employed
by
the
employer
and
16
the
replacement
of
the
prosthetic
device
would
be
considered
17
reasonable
medical
care
under
this
chapter.

EXPLANATION
19
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
20
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
requires
an
employer
to
furnish
to
an
employee
22
a
replacement
permanent
prosthetic
device
that
is
medically
23
necessary
as
a
result
of
a
compensable
injury
that
occurred
24
while
the
employee
was
employed
by
the
employer
and
the
25
replacement
of
the
prosthetic
device
would
be
considered
26
reasonable
medical
care
for
the
purposes
of
workers’
27
compensation.
