Section
1.
Section
321M.5,
Code
2022,
is
amended
by
adding
1
the
following
new
subsection:
2
NEW
SUBSECTION
.
4.
a.
A
county
certified
to
issue
3
commercial
driver’s
licenses
under
section
321M.6
may
notify
4
the
department,
in
a
manner
determined
by
the
department,
5
that
the
county
plans
to
increase
commercial
driver’s
license
6
testing
by
at
least
one
additional
full-time
equivalent
7
position.
If
the
county
so
notifies
the
department,
the
county
8
and
the
department
shall
execute
an
addendum
to
the
agreement
9
required
under
subsection
1,
subject
to
paragraph
“d”
.
10
b.
The
addendum
shall
provide
that
the
department
shall
pay
11
to
the
county
fifty
percent
of
the
total
cost
of
one
additional
12
full-time
equivalent
position
designated
by
the
county
for
the
13
administration
of
commercial
driver’s
license
driving
skills
14
tests.
The
addendum
shall
be
effective
for
not
more
than
two
15
years.

c.
To
pay
counties
under
addendums
provided
for
in
this
17
subsection,
the
department
shall
use
moneys
appropriated
18
to
the
department
from
the
road
use
tax
fund
for
salaries,
19
support,
maintenance,
and
miscellaneous
purposes
by
the
general
20
assembly,
unless
moneys
are
appropriated
to
the
department
21
by
the
general
assembly
for
the
specific
purpose
of
paying
22
counties
under
such
addendums.

d.
A
county
and
the
department
shall
not
execute
more
than
24
one
addendum
under
this
subsection.
The
department
shall
not
25
execute
addendums
with
more
than
five
counties
under
this
26
subsection.

e.
This
subsection
is
repealed
July
1,
2025.

Sec.
2.
RETROACTIVE
APPLICABILITY.
This
Act
applies
to
29
full-time
equivalent
positions
designated
by
a
county
for
the
30
administration
of
commercial
driver’s
license
driving
skills
31
tests
added
by
the
county
on
or
after
July
1,
2021.

inclusion
of
this
explanation
does
not
constitute
agreement
with

the
explanation’s
substance
by
the
members
of
the
general
assembly.

Under
current
law,
the
department
of
transportation
(DOT)
1
and
each
county
participating
in
county
driver’s
license
2
issuance
must
execute
a
Code
chapter
28E
agreement
detailing
3
the
relative
responsibilities
and
liabilities
of
each
party
to
4
the
agreement.
5
This
bill
allows
a
county
certified
to
issue
commercial
6
driver’s
licenses
(CDLs)
to
notify
the
DOT
that
the
county
7
plans
to
increase
CDL
testing
by
at
least
one
additional
8
full-time
equivalent
position
(FTE).
If
the
county
so
notifies
9
the
DOT,
the
bill
requires
the
county
and
the
DOT
to
execute
an
10
addendum
to
the
Code
chapter
28E
agreement.
11
Under
the
addendum,
the
DOT
must
pay
to
the
county
50
percent
12
of
the
total
cost
of
one
additional
FTE
designated
by
the
13
county
for
the
administration
of
CDL
driving
skills
tests.
The
14
bill
prohibits
the
addendum
from
being
effective
for
more
than
15
two
years,
prohibits
a
county
and
the
DOT
from
executing
more
16
than
one
addendum
under
the
bill,
and
prohibits
the
DOT
from
17
executing
addendums
with
more
than
five
counties
under
the
18
bill.
19
The
bill
is
repealed
July
1,
2025.
The
bill
applies
20
retroactively
to
FTEs
designated
by
a
county
for
the
21
administration
of
CDL
driving
skills
tests
added
by
the
county
22
on
or
after
July
1,
2021.
