H.F. 2334 Section 1. Section 321.176A, subsection 2, Code 2022, is 1 amended to read as follows: 2 2. A fire fighter while operating a fire vehicle for a 3 volunteer or paid fire organization , or a peace officer, as 4 defined in section 801.4 , while operating a commercial motor 5 vehicle for a law enforcement agency, or a member of the 6 department of homeland security and emergency management or a 7 local emergency management agency, as defined in section 29C.2, 8 while operating a commercial motor vehicle, under conditions 9 necessary to preserve life or property or to execute related 10 emergency governmental functions. 11 Sec. 2. Section 321.176A, subsection 7, Code 2022, is 12 amended by striking the subsection. 13 EXPLANATION 14 The inclusion of this explanation does not constitute agreement with 15 the explanation’s substance by the members of the general assembly. 16 Under current law, the following are exempt from commercial 17 driver’s license requirements: a farmer or a person working 18 for a farmer under certain circumstances, a fire fighter while 19 operating a fire vehicle or a peace officer while operating a 20 commercial motor vehicle for a law enforcement agency under 21 conditions necessary to preserve life or property or to execute 22 related governmental functions, certain persons in the military 23 when operating commercial motor vehicles for military purposes, 24 a person while operating a motor home solely for personal or 25 family use, a person operating a motor vehicle with a gross 26 vehicle weight rating of less than 26,001 pounds towing a 27 travel trailer solely for personal or family use, a person 28 exempted by department of transportation rules pursuant to 29 Code section 321.176B, and a home care aide operating a motor 30 vehicle in the course of the home care aide’s duties. 31 This bill expands the exemption for fire fighters and peace 32 officers to include members of the department of homeland 33 security and emergency management or a local emergency 34 management agency.
