H.F. 2321 Section 1. Section 392.5, Code 2022, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 4. When residents of a city served by a 3 library board express concern about a specific book or other 4 material, the council may, by majority vote, overturn a library 5 board’s decision to place the book or other material in a 6 particular location within the library. If the council votes 7 to overturn the library board’s decision, the council shall 8 provide direction to the library board for placement of the 9 book or other material, which may include placing the book or 10 other material in a secure location and limiting check-out 11 privileges for the book or other material to adults if the book 12 or other material is considered sensitive in nature. 13 EXPLANATION 14 The inclusion of this explanation does not constitute agreement with 15 the explanation’s substance by the members of the general assembly. 16 This bill relates to the placement of books and other 17 materials in city libraries. The bill provides that when 18 residents of a city served by a library board express concern 19 about a specific book or other material, the city council may, 20 by majority vote, overturn a library board’s decision to place 21 the book or other material in a particular location within a 22 library.
