H.F. 2242 Section 1. Section 915.13, subsection 1, paragraph f, Code 1 2022, is amended to read as follows: 2 f. Except where the prosecuting county attorney determines 3 that disclosure of such information , including the provision 4 of reports prepared by law enforcement under subsection 3, 5 would unreasonably interfere with the investigation, at the 6 request of the registered victim, notice of the status of the 7 investigation shall be provided by law enforcement authorities 8 investigating the case, until the alleged assailant is 9 apprehended or the investigation is closed. 10 Sec. 2. Section 915.13, Code 2022, is amended by adding the 11 following new subsection: 12 NEW SUBSECTION . 3. Subject to subsection 1, the county 13 attorney shall provide a victim registered with the county 14 attorney’s office with a copy of any reports prepared by law 15 enforcement upon the filing of a complaint against a defendant 16 in a criminal case relating to the crime for which the person 17 is a registered victim. 18 EXPLANATION 19 The inclusion of this explanation does not constitute agreement with 20 the explanation’s substance by the members of the general assembly. 21 This bill relates to the provision of law enforcement 22 records to a registered victim. 23 The bill provides that a county attorney shall provide a 24 victim registered with the county attorney’s office with a copy 25 of any reports prepared by law enforcement upon the filing of a 26 complaint against a defendant in a criminal case relating to 27 the crime for which the person is a registered victim. 28 The bill provides that if the prosecuting attorney 29 determines that disclosure of reports prepared by law 30 enforcement would unreasonably interfere with the investigation 31 of the case, the county attorney can withhold the release of 32 the reports from the victim. 33 -1- LSB 6139YH (4) 89 as/rh 1/ 1
